iN e)(e rcise of the powers conferred by section 35B of the Medical

and Kindred Professions O rdinancc. the Minister of Healt h on the

advice of the Council of Health. has made the following regulations:-

(I) These regula tions may be cited as the D OIgs (Control)

(Amendment) Regulations. 1986, and shall be read and constOled as

one wit h the Drugs (Control) Regulations. 1985, he reinafte r rderred to

as .. the principal regu lations".

(2) These regulmions shall

2, Immediately after regulation 8 of the principal regulations

there shall be added the following new regu latioll: -

SA . (I) Wi thout prejudice 10 the provisions of regu-

la) no medical practitioner may prescribe any spe-

cified drug 10 any per~:m unless such person is in pos-

session of a Conlrol Card_ as per Nint h Schedule 10 Ihese

regula tions. issued for the purpose by the Super-

intendent of Pu blic Health ;

(b) in prescribingany s pttificd drug to anypcrson.

the prescriber shall enter in a clear. indelible and legible

manner all the deta ils set out in colum ns I to 4 of the

Conlrol Card. and shall thcn relurn the card 10 such

person IOgelher wi lh Ihe prescription.

(2) The Superintende nt shall issue such Conlrol

Card 10 the person concerned on receipt of a req u~1. from a

medical practitioner to this effect. made on the form (IS se t out

in the Te mh Schedule to thesc regulations.

(3) No Control Ca rd shall be valid in e)(ccss of a

period o f onc vear from the date on whie h it is issued . unless it

is renewcd by the SuperintClldent following a request by a

medicOlI prOlctitioner to this cffcct. Oflthc fo rm se t ou t in the

(6) (i) Notwithstand ing the proviSIOn S of this

regulation, it shaIJ be lawful for a medical practitione r to

prescribe in urgent cases a drug to a patien t who is oot in

possession of a Control Card provided that :-

(I)

the prescription i!.labelled " URGENT';

(2) the amount prescribed does nO! exceed three

days supply;

(3) it complies wilh other requireme nts of these

regulations; and

(4) the prescriber notifies the Superintendent

within 48 hour.; of issuing such prescription. giving full

paniculars of the patient . the name. fonn. dose and

amou nt o f drog prescribed, and the rC8llOn for the

urgency.

(ii) It shall be lawful fOf an apothecary to

dispensc such a prescription complying with items( l) , (2)

and (3) of sub-paragraph (i) of this paragraph.

(7) The provisions of this regulation shall not

apply 10 the prescription of specified drugs by a medical

practi tio ne r employed in a Governme nt hospital. for adminis-

tration to ward patienlS at that time under his care in such

hospi tal. which prescription shaD be controlled by Ilospital

inte rnal rules.

(8) Any request or notification in terms of this

regula tion may be made in person or sent by post in a sealed

e nvelope add ressed to the Superintendent of Public Health.

(9) For the purpose of Ihis regulation. the expres-

sion " medical practitioner" includes a dental surgeon and B
