Fish Marketing (Amf ndmeDt) Regulations, 1986

IN exercise of the powers conferred by section 3 of the Fish

tndustry Act. 1953, the Minister of Agriculture and Fisheries has made

the fol lowing regulations:-

When maling paymenUl, in terms of the pceceding

regulation, the Director shall deduct an amount equivalent to 6.3

per cent or \0 per cent from the amounUl due to the fish~an and

the importer respeetively. l n both cases the amount to be paId to the

pitka\ as remuneration for bis services shall be 6.3 per cent of the

amount of the registered sales.

(2 ) Th e Director shall deduct from the amounts due

to the pitkal any amount due by any retailer for fish sold to such

retailer by such pitka!.

(3) Where the amount due by retailers for fish sold to

them by a pilkal is more than the alllOllnt due to such. pitkal, !be

Director may notify the piLkal 10 pay such sum in ~cess of lhe

amount due to him within a period fixed by the said Dir«tor,

such period being not less than fifteen days, and if the pitkal does

not effect the said payment the Director may suspend the reLative

licence until slICh payment is effected, so howcvec that, if the

amount is nOI setteld within a period of three months from the

date of such notification, the relative licence shall be deemed to

have been revoked, saving the Director's right to claim the

amount involved.

(4) Where any amount due by a retailer has been

deducted from the amount due to a pitkal or has been paid by, a

pitkal in accordance with this regUlation, such pitkal shall notwith-

standing the provisions of regulation 25 have a right to claim such

amount directly from the retailer.".

J. 1n regulation 26 of the principal reguLations for the words "The Amend,

In the regulation 27 of the principal regulations the words “who

shall, thereafter, be held responsible for the payment in respect of any

sales made by him in contravention of this regulation”, shall be deleted.

The amendments effected by these regulations shall only

apply in respect of sales made after the coming into force of these regu-

lations.

4. Fir-regolament 27 tar-regolamenti prinċipali il-kliem “li, wara

dan, jinżamm responsabbli għall-ħlas għal kull bejgħ magħmul minnu

b’kontravenzjoni ta’ dan ir-regolament” għandhom jitħassru.

5. It-tibdil li qiegħed isir b’dawn ir-regolamenti ikun jgħodd biss

għar-rigward ta’ dak il-bejgħ li jsir wara li jidħlu fis-seħħ dawn

ir-regolamenti.
