IN uereise of [be powers conferred by section 40 of the Pu blic

Registry Act, the Senior Deputy Prime Minister and Minister of Justice

and Parliamentarv Affa irs has made the following regulations:-

I . These rcgulaliO!1!i ma y be cited as the Pu blic R egistry (Dupli-

cate Nares) Regulations, 1984.

to make duplicate notes of any original no tes for the regis tration o f any

ca use of preIerence among credit<ml. DOles of reference or nOles of

enrolment deposited in the Public Registry in Ma lta or in the Publ ic

Registry in GOlo. where the original note has been 1051. destroyed or

damaged, and 10 make a new regiSleT in substi tution of any register lost.

0) The malr::ing of the duplicate notes and new regislers shall

be compiled by mIIlr::ing reference to the respective register and original

nOle, as th e ca se may be. kept in the Public Registry Of by reference to

the relative deed. and reprod ucing the relevant information therein

con tai ned on the d uplicate note or new registl'"f as the case may be.

I)! The dupli cate notes or new registers may be made by the

process of microfilmi ng. which shal1 be carried out on the premises of

Ihe Pu blic Registry in Malta and in Gozo and under Ihe supervision of

the pertinent Direc tor of that Registry.

J. Thc provisions of the Public Rcgistry Act and of the Civil Code

relating to the formu la tion of the notcs mentioned in these regula tions

shall apply to duplicate notes and new registers made under these

regulahOnS .

(1 1 The dupl icate notes or new registers prepared in accor·

dance with these regulations shall be authenticated by the Director o f

the Pu blic Registry or by an Assistant Director. and the Director or such

Assistant Director shall ensu re that the information contained in the

duplica te nOle or new register. conforms to the information con tained or

.... hich OIIsht to have been conmined in th e original note or register.

12) The Director of the Pu blic Registry shall indicate the

duplicate nOles Of new registers which ha ve been made in accordance

with these regulations and the date and the source thereof.

making of duplicate notes and new registers of notes of renewa ls of
