In exercise: of the powers conferred by section 9 of IlK: Dangerous

Drugs Ordinance, the Minister of Health. on lhe ad~ice of lhe Coul'lcil

of Heahh. has made the following rules:-

\. These rules may be cited as Ihe Dangerous Drug:;; (Inlema'

Control) (Amendment) R ules. 19S1. and ~halJ be read and construed as

onc with the Dangerous Drugs (Internal Control) Rules. 1939. herein-

after referred (0 as "tile principal rules",

Pro\"ided that in the ca>e of a medical practitioner a utho-

rised 10 practise the medical profession ul1<kr section 4 of the

Medical and Kindred Prof~ns Ordinance bUI who i:s not yet

registered " 'iih the Med ical COl.mcilsuch practi tioner shall insert

the nu mber gi"en to him by the Superinte ndent of Public Health

instead o f the '\Iedical Council re~trat ion number on the said

prescription .

(3) SUbject to the provisions of paragraph {I I) of thi l

rule. 00 medical practitioner sh.all issue a prescription for the supply

o f Ihe d rugs unless the prescription complies with the provisions of

paragraphs (I) and (2) of this rule , and unless thc drugs are required

for the purpose of medical treatment

\' rQvided thal-3 medical practitioner may. subject to the

o lher provisions of these rules, issue a prescription for professional

twenty tablets or capsules

Provided further that -

(i) in the case of a d eni al surgeon o r a dentist a

prescription may o nly be issued for the pUlJ'OS"s of denial

treatme nt and such prescription shall be marked "fOf dental

treatment only": and

(ii) in the case of a "cicrinary surgeon a pre-

scription shall only be issued fOI the PUIJlOSCS of trealme nt

o f animals and shall be marked "for animal treatment only"·,

EveI)' medical pract itioner who obtains the drugs

for professional use as provided for in the tiBt pro,i5Q to parngraph

(J) of this rule, shall kCt:p , in accorduncc with. and without pre-

judice 10. the provi!;ions of rule 10 of Ih"", rules. a record in an

appropriate register. or the name and wrname. if applicable. the

age and address of the p"uient to whom the drug has been adminis-

tered and the date of administration and the medical indication for

admin istering the drug .

(5) No medical practitioner sha ll issue a prcl'Cription for

Ihe drugs to any perwn unlQ.s such pel'5On is wcll kllOwn 10 him or

unless the medical prncIitioner has asa:: n ained t he identity of ,",ch

peniOn through the identity card issued under lhe Identity Card ".-.U"'t97j

Act. 1975.

(6) No medial praCtilioner shall issue 8 prcs.:ription for

the drugs 10 any persoo unless the ,..id medical praclitioner has

laken reasonably sulfi.lXnt steps to asa:nain tha t $Ueh pel'5On ~ not

al Ihe time of issuing the prescriplion. recen'ing treatmen t from

anothe r med ical practitio ner in respect of addiction to any of the

drugs or othe rwise. und Ihat such person has not been §upplied " ith

any of !;Ueh drugs on a prescript ion issued by that Olher medical

practi tione r.

( 7) A medical practitioner sllall w;: a scpmue form in

respect of ",-cl)' drug prc§CTibed by him under IhcJ;C rules. and 00

of the Drugs (Con trol ) Regulalions. 197b. apply. may be

pre$(ribed on these: forms.

(8) A medical practitioner shall in prescribing the

drugs use only prescription fonns from the booklets or forrm; in

serial number issued to him by the Superintendent of Public Healt h

upon a request made ()(l the fonn set ou t in Schedule B 10 these

rules and il sball be the: duty of a medical practitioner . .... hether for

the purpose of his private practice or for carrying OUt his duties in an

official capacity as a restJll of his emplo~'menl .. ·;th GO\·cmmcnl.

with a view to meeting the nceds of his palien ts. 10 make a ~UCSI

for such prescription booklets on the said form: such reqUCSt form

shall be correctly filled in all respects and signed by the practitio ner.

and shall be either handed in personally to the Chief PhannaciSl at

(9) It shall be lhe dUly of a medical practitioner to

repon in writing forth .... ith to the Superintendent of Public Hea!th

an y case of theft or Iossofsuch booklel and it 5hall not be lawful for

a medical practitioner to use any prescri ption form from any book·

let of forms issued to anothe r medical practitioner.

(10) For the purpose of this rule , unless the l~)t\text

o therwise requires. the expression "medical practitione r" includes

11 (!cntal surgeon. a demisI and a ~e terinal)' surgeon.

{I I ) The provisions of paragraphs (I). (2). (7) and. in SO

f:.r a~ applicable , uf para,!;ral)hs (8) and (9 ) of this rule shall nol

apply to the prescription of thc drugs for administration to ward

p;! ticnts in Go"c rnmerll ~pitals. which prescription shall be cont ·

rolled by the ~pi tal imernal rub. "

a licensed dispensary to send to the Superintendcm of Public

Health in a sealed envelope on Ihe tirst day of every month allthc

pre",:riptions for the drugs dispensed from that dispensary during

may be marked " Public Health Notifications" for the 1lIl'l""'W' of
