Declaration of Certain Rights (Burthens for Masses) Order, 1983

IN exercise of the powers conferred by seotion 14B of the Land

Registration Act, 198 J, the Senior Deputy Prime Minister and Minister

of Justice and Parliamentary Affairs has made the following order:-

l. This Order may be cited as the Declaration of Certain Rights

(Burthens for Masses) Order, 1983, and shall come into force on the

15th July, 1983.

In this Order -

"burthen" means any obligation on the proprietor of any

imrnovable property whereby any rents or other civi1 fruits deriving

from such property are to be employed or paid for the celebration

of Masses for the repose of souls, or whereby any payment in

respeot of such propeliy is to be made for such purpose

"person" inc1udes group of persons.

(l) Any person whose land is, on the coming into force of

rhis Order, subject to a burthen, or in favour of whom on such da te a

burthen is irnposed on any land shall dec1are such burthen to the Land

Registrar by not later than 17th October, 1983.

(2) Where any burthen is imposed on any land after the

coming into force of this Order any person on whose land or in favour

of whom such burthen is imposed shall declare such burthen to the Land

Registrar not later than three months from the imposition of such

burthen.
