MALTA ARMED FORCES ACT, 1970

Armcd Forces of Malta (Regular Force) (Appointments and

Conditions of Service) (Amendment) (No. 2) Regulations, 1982

IN exercise of the powers conferred by section 4 of the Malta

Armed Forces Act. 1970. the President of Malta has made the follow-

ing regulations: -

These regulations may be cited as the Armed Forces of Malta

(Regolar Force) (Appointments and Conditions of Service) (Amend-

ment) (No. 2) Regulations. 1982. and shall be read and construed as one

with the Arrned Forces of Malta (Regular Force) (Appointments and

Conditions of Service) ReguJations, 1970. hereinafter referred to as "the

principal regulations".

Regulation 12 of the principal regulations sha11 be amended as

follows:-

(a)

the present provision shall be renumbered as paragraph

(I); and

(b) immediately after paragraph (1) as renumbered there

shal1 be added the following new paragraph

"(2) Notwithstanding the provisions of paragraph (1)

of this regulation. a police officer commissioned in the force

on or before the 1st October. 1982 may opt to retire on

any day on which he would have been entitled to retire had he

remained in the Malta Po1ice Force and all the provisions of

the Pensions Ordinance which wou1d have been applicable to

him had he remained in the Malta Police Force shall be appli-

cable to him on his retirement from the force; and for the

purposes of the said Ordinance service in the force shall count

as service in the Malta Police Force.".

Immediately after regolation 26 of the principal regulations

there shaH be added the following new regulation

"Maximum

A man shall not have any reserve liability beyond

the age of 55 years.".

4. 1mmediately after regulation 29 of the principal regulations

there shall be added the following new regulation

5. Il-Karta ta' l-Avviż taħt it-Taqsima I tat-Tieni Skeda li tinsab

mar-regolamenti prinċipali għandha tiġi emenda ta kif ġej

(a) minnufih wara l-paragrafu l tagħha għan du jiżdied il-

paragrafu ġdid li ġej

"IA. Jekk ingaġġajt diġa taħt ir-regolament 24(l)(c)

iżżomm

id-dritt li tispiċċa s-servizz tiegħek mal-forza fi kwa-

lunkwe jum li fih kien ikollok jedd li tirtira kieku bqajt mal-

Korp tal-Pulizija ta' Malta u d-disposizzjonijiet kollha ta' l-

Ordinanza dwar il-Pensjonijiet li kienu jkunu applikabbli għa­

lik kieku bqajt fil-Korp tal-Pulizija ta' Malta jkunu applikabbli

għalik meta ttemm is-servizz mal-forza; u għall-finijiet ta' l-

imsemmija Ordinanza servizz mal-forza jingħadd bħala ser-

vizz fil-Korp tal-Pulizija ta' Malta."; u

(b) minnufih wara l-partita (3) tas-sub-paragrafu e. tal-para-

grafu 3 tagħha għandha tiżdied il-partita ġdida li ġejja

A police officer en1isted in the force on or before

conditions

the l st October. 1982 may opt to terminate his service on

any day on which he would have been entitled to retire had he

remained in the Malta Police Force and all the provisions of

the Pensions Ordinance which would have been applicable to

him had he remained in the Malta Po1ice Force shall be appli-

cable to him on his termination of service from the force; and

for the purposes of the said Ordinance service in the force

shall count as service in the Malta Police Force.".

5. The Notice Paper under Part I of the Second Schedule to the

principal regulations shall be amended as follows

(a) immediately after paragraph l thereof there shall be

added the following new paragra ph

"IA. If you have already enlisted under regulation

24(1 )(c) you will retain your right to terminate your service

from the force on any day on which you would have been

entit1ed to retire had you remained in the Malta Police Force

and all the provisions of the Pensions Ordinance which would

have been applicable to you had you remained in the Malta

Police Force shall be applicable to you on your termination

of service from the force; and for the purposes of the said

Ordinance service in the force shall count as service in the

Malta Police Force."; and

(b) immediately after item (3) of sub-paragraph e. of para-

graph 3 thereof there shall be added the following new item

"(4)

On attaining the age of 55 years

NIL".
