Land Registration (Amendment) Rules, 1982

IN exercise of the powers conferred by section 57 of the Land

Registration Act, 1981, the Senior Deputy Prime Minister and Minister

of lustice and Parliamentary Affairs has made the following rules:-

These rules may be cited as the Land Registration (Amend-

ment) Rules, 1982, and shall be read and construed as one with the Land

Registration Rules, 1982, hereinafter referred to as "the principal rules".

In the Maltese text of sub-paragraph (a) of paragraph (2) of

Iule 12 of the principal rules the words "fuq il-formola ġusta jew" shall

Rule 23 of the principal rules shaB be amended as follows

(a) for the Maltese text of paragraph (2) thereof there shall

be substituted the following

"(2)

Il-formola trid tkun

(a) miktuba bI-idejn b'ittri kbar majjuskoli, b'inka

sewda skura, jew ittajpjata bI-iswed u tkun tista' tiġi

kkupjata bi proċess ta' fotokopjar;

(b) meta tkun ittajpjata b'typewriter tkun l-oriġinali

sakemm il-formola ma tkunx trid tiġi ppreżentata in dupli-

kat, f'liema każ parti minnha trid tkun l-oriġinal;

(ċ)

ma titlifx il-lewn u ma tkunx imtebba';

(d)

bla ebda pjanta li ma tkunx b'inka sewda; u

ikollha riferenza gtlal kull anness magħha."; and

(e)

(b) at the end of paragraph (4) thereof there shaH be added

the following words

"In this paragraph the expression "words" inc1udes

numbers, cipher or any other symbol.".

Rule 30 of the principal rules shaH be amended as follows

(a)

(i) the present rule shaH be renumbered as para-

(ii) immediately after item l thereof there shaH be

inserted the following new item

"l A. A certificate of Land shaH be in accordance

with Form No. IA."; and

(iii) immediately after item 34 thereof there shaB be

inserted the following new item

"35. Charge Certificate shaH be in accordance with

Form No. 35."; and

(b) immediately after paragraph (l) thereof as renumbered

there shaH be inserted the following new paragraph

"(2) The prescribed forms shaH be used for the

subject to which they refer, or to which they may be used or

adopted with such alterations or additions which may be

required, as the Registrar may aHow.".

The First Schedule to the principal rules shaH be amended as

(a) immediately after Form No. l there shaH be inserted

Form No. IA as shown in the Schedule to these rules; and

(b) immediately after Form No. 34 there shaH be added Form

No. 35 as shown in the Schedule to these rules.
