FACTORIES ORDINANCE (CAP. 169)

Factories (Hoists and Lifts) (Amendment) Regulations, 1982

IN exercise of the powers conferred by section 3 of the Factories

Ordinance. the Minister of Labour and Social Services has made the

following regulations: - -

I. (1) These regulations may be cited as the Factories <Hoists

and Lifts) (Amendment) Regulations. 1982, and shall be read and con-

strued as one with the Factories (Hoists and Lifts) Regulations, 1964.

L.N. 47 of 1964 hereinafter referred to as "the principal regulations".

(2) These regulations shall come into force after twenty-one

days from the day on which they are laid on the Table of the House of

Representatives in accordance with the provisions of subsection (3) of

section 3 of the Factories Ordinance, which date shall be notified by

the Minister by notice in the Gazette.

diem imsejħa "ir-regolamenti prinċipali".

(2) Dawn ir-regolamenti għandhom jibdew iseħħu wara

u għoxrin ġurnata mill-ġurnata li fiha jitqiegħdu fuq il-Mejda

tal-Kamra tad-Deputati skond id-disposizzjonijiet tas-subartikolu (3) ta'

l-artikolu 3 ta' l-Ordinanza dwar il-Fabbriki, liema data għandha tiġi

avżata mill-Ministru b'avviż fil-Gazzetta.

Regulation 3 of the principal regulations shall be amended as

follows

(a) in the proviso to paragraph (2) thereof -

(i) for the words "Higher Technician Diploma awarded

by the Malta College of Arts, Science and Technology" there

shall be substituted the words "a degree in Mechanical of

Electrical Engineering of the University of Malta"; and

(iD the words "or superior" shall be deleted; and

(b) for paragraph (3) thereof there shall be substituted the

fol1owing new paragraphs

"(3) Every owner or occupier of any premises or open

space to which these regulations apply shall cause the lift or

hoist therein instal1ed to be examined by a competent person

as provided in paragraph (2) of this regulation and shall send

to the Director a report of such examination, drawn up by

such competent person in the form laid down in the Schedule

hereto so as to reach the Director not later than twenty-eight

days from the date on which the examination falls due.

(4) Every owner or occupier as aforesaid shall ensure

that any repairs, renewals or a1terations of parts of the hoists

and lifts as are dec1ared by the competent person to be requir-

ed for the safe use of the hoist or lift, shall be effected with-

out delay and not later than the time notified in writing to

such owner or occupier by the Director.".
