AGRICULTURAL AND FISHING INDUSTIUES

(FINANCIAL ASSISTANCE) ACT, 1956

(ACT NO. 11 OF 1956)

Arrangements for the p.rovisions. of l<�illancial Assistance

THE following arrangements made in persuance of section 3 (I) of

the Agricultural and Fishing Industries (Financial Assistance) Act. 1956

L (l) The Director of Agriculture and Fisheries, a representa

tive of the Attorney General, a representative of the Secretary,

Ministry of Finance, Customs and People's Financial Investments,

the Manager or the Assistant Manager of the Milk Marketing Under

taking and an Assistant l-lead in the Department of Agricuiture and

Fisheries shaH constitute a Commission to consider applications for

financial assistance under the Act.

(2) The Director of AgricuJture and Fisheries shall be the

Chairman of the Commission and he shall designate an officer of the

Department of Agriculture to act as Sccretary to the Commission.

(1) Id-Direttur ta' l-Aglikoltura u Sajd, rappreżentant ta'

l-Avukat Ġenerali, rappreżentant tas-Segretarju, Ministeru tal-Fin

anzi, Dwana u Investimenti Finanzjarja tal-Poplu, il-Manager jew

l-Assistent Manager ta' l-Impriża tal-Ħalib u Assistent Kap fid-Dipar

Applications for financial assistance under the Act shalI be

made on a form appr ov ed by the Commission which sha1I be sent to

the Secretary of the Commission at the Department of Agriculture.

Only citizens of Malta permanently resident in Malta shaIl

be entitled to apply for assistance under the Act.

Applicants for financial assistance shall furnish to the Com

mission such information and evidence as the Commission may re

quire for the purpose of considering the application.

Financial assistance under the Act shaH only be given on the

recommendation of the Commission with the approva l of the Minis

ter responsible for Agriculture and Fisheries 01' an officer nominated

by him for the purpose.

Any agreement relating to the giving of financial assistance

under the Act shaH be made by a private writing or by a notarial deed,

as the case may require, and shaH be executed on behalf of the Go

vernment of Malta by the Director of Agriculture and Fisheries, 01'

by an officer not below the rank of Assistant Read in the Department

of Agriculture delegated by the Director to act in this behalf.

Financial assistance under the Act may be given subject to

such conditions, agreements and obligations imposed upon 01' under

taken by the recipient as the Commission may advise. Such condi

tions and obligations shall include an undertaking on the par t of the

recipient --

(a) to repay any loan together with the interest thereon

in accordance with the terms of the agreement;

(b) not to sell nar dispose of in any other manner, the pro

perty in or the possession of anything a cquired or improved with

the aid of a 10an or grant without the previous consent in writing

of the Minister responsible for Agriculture and Fisheries before

the loan is completely repaid or, in the case of a grant, during

such period as the agreement may prescribe;

(c) to maintain anything purchased or improved with the

aid of the financial assistance afforded, in proper order and con

dition to the satisfaction of the Minister responsible for Agricul

ture and Fisheries, and al10w any person authorised by the

Minister responsible for Agriculture and Fisheries to inspect

such thing at all reasonable times;

(d) in the event of the recipjent failing to comply with all

the terms of the agreement with the Government entered into

by him in respect of the financial assistance afforded, the total

amount of such assistance shaH become repayable to the Govern

ment immediately.

Loans made under these arrangements sha1l be repaid

as

follows

Up to fl,OOO with in a maximum period of 5 years.

Over fl,OOO and up to f3,000 within a maximum period of 7

years.

Over 0,000 and up to f5,000 within a maximum period of 10

years.

Over f5,000 and up to flO,OOO within a maximum period of 15

years.

Over flO,OOO withjn a maximum period of 20 years.

The rate of interest payable on loans made under the terms

of these arrangements, shaH be at rates of not less than three per cen

tum per annum nar more than the ruling commercial rate of interest.

This Notice shall supersede all previous arrangements.
