Port Rates (Amendment) (No. 3) Regu]ations, 1981

IN exercise of the powers conferred by section 42 of the Ports

Ordinance, 1962, the Minister of Development, Energy, Port and

Telecommunications, with the concurrence of the Minister of

Finance, Customs and People's Financial Investments, has made the

following regulations:-

These regulations may be cited as the Port Rates (Amend­

ment) (No. 3) Regulations, 1981, and shall be read and construed as

one with the Port Rates Regulations, 1969, hereinafter referred to as

"the principal regulations".

The First Schedule to the

nmended as foIlows:-

in Part I thereof, for sub-paragraph (a) of paragraph l

(a)

there shall be substituted the following new sub-paragraph

"(a) in respect of goods handIed at the Deep Water

Quay, Shipwrights Wharf, Coal Wharf, Laboratory Wharf,

Xatt ir-Risq (formerly Garden Reach),

Flagstone Wharf,

Timber Wharr or Lighter's Wharf whether lighters are used

or not, the rate shown in Column 2 of that Table;"; and

(b) in Part II thereof, for sub-paragraphs (a) and (b) of

paragraph l there shalI be substituted the following new sub­

paragraphs

"(a) in respect of goods presented by arrangement

with the Director of Ports or his contractor, as the case

may be, direct1y under ship's tackle at the Deep Water Quay,

Shipwrights Wharf, Coal Wharf, Laboratory Wharf, Xatt

ir-Risq (formerly Garden Reach), Flagstone Wharf, Timber

Wharf or Lighter's Wharf by exporter's transport, and in

respect of goods handled elsewhere where Iighters are not

used, the rates shown in C o Iu n m 3 of that Table

Provided that where such goods are locally manufac­

tured the rates shall be those shown in Column 5 of that

TabIe;

(b) in respect of goods handIed at the Deep Water

Quay, Shipwrights Wharf, CoaI Wharf, Laboratory Wharf,

Xatt ir-Risq (formerly Garden Reach), FIagstone Wharf,

Timber Wharf or Lighter's Wharf, other than goods handIed

thereat as specified in sub-paragraph (a) of this paragraph,

and in respect of goods handIed elsewhere where lighters

are used, the rates shown in Column 2 of the Table im­

mediately following

Provided that when such goods are localIy manufac­

tured the rates shall be those shown in CoIumn 4 of that

Table.".

The Seventh Schedule to the principal reguIations shall be

amended as follows:-

(a) in Part I thereof, for sub-paragraph (a) of paragraph 1

there shall be substituted the fol1owing new sub-paragraph

"(a) in respect of unit loads or unitised cargo handIed

at the Deep Water Quay, Shipwrights Wharf, Coal Wharf,

Laboratory Wharf, Xatt ir-Risq (formerly Garden Reach),

Flagstone Wharf, Timber W h ar f or Lighter's Wharf, whet­

her Iighters areused or not, the ra te shown in CoIumn 2 of

that TabIe;"; and

(b) in Pat t II thereof, for sub-paragraphs (a) and (b) of

paragraph 1 there shall be substituted the following new sub­

paragraphs

"(a)

respect of unit loads or unitised cargo which

(i) presented by arrangement with the Director of

(ii) handIed elsewhere when Iighters are not used,

the rate shown in Column 3 of that TabIe;

(b) in respect of unit loads or unitised cargo handIed

at the Deep Water Quay, Shipwrights Whati, CoaI Wharf,

Laboratory Wharf, Xatt ir-Risq (formerly Garden Reach),

Flagstone Wharf, Timber Whati or Lighter's Wharf or in

respect of unit loads or u.nitised cargo handIed eIsewhere

when jighters are used, the rate shaH be that shown in

Column 2 of that Table

Provided that when such unit loads or unitised cargo

as are mentioned in sub-paragraphs (a) and (b) of this

paragraph are locally manufactured goods, the rate shalI be

that shown in Column 4 of that Table.".
