PORT WORKERS ORDINANCE, 1962

Port Workers (Amendment) (No. 2) Regulations, 1980

IN exercise of the powers conferred by section 16 of the Port

Workers Ordinance, 1962, the Minister of Development, Energy, Port

and Telecommunications has made the following reguiations:-

( 1) These regulations may be cited as the Port Workers

(AmendmenO (No. 2) Regulations, 1980, and shall be read and con­

strued as one with the Port Workers Regulations, 1966 , hereinafter

S. Minnufih wara l-paragrafu (2) tar-regolament 26 tar-regola­

menti prinċipali għandhom jidħlu l-paragrafi ġodda li ġejjin

tas-sub-paragrafu (b) tal-paragrafu (2) ta' dan ir-regolament ma

Fir-regolament 27 tar-regolamenti prinċipali, minflok il-kliem

għandhom

L-Iskeda 4 li tinsab mar-regolamenti prinċipali għandha tiġi

emendata kif ġej

(a) minflok il-figura "f550" fil-paragrafu 1 tagħha għandha

tidħol il-figura "i580";

(b) minflok il-figuri "fIl 0", "f220", "030", ",[440" and

"f550" fil-kolonna 2 tal-paragrafu 2, u tas-sub-paragrafu (i) tal-pa­

ragrafu 6 tagħha għandhom jidħlu rispettivament il-figuri "f116",

"f232", "f348", "f464" u "f580"; u

(ċ) minflok il-figuri "058" u "f246" fil-kolonna 2 tal-pa­

ragrafu 7 tagħha, għandhom jidħlu rispettivamet il-figuri "f377" u

"f259".

Port workers who on or after the fourth day

of April, 1973, but not 1ater than the fourth day of January,

1980, have attained the retiring age shaB have their registra­

tion canceIled by the Direcior and thereupon shall be paid

a pension or a gratuity under the conditions and at the rates

specified in regu1ation 27 of, and in Schedule 4 to, these

regu1ations.

(2) Port workers who on or after the fifth day of

January, 1980, have attained the retiring age shaH have their

registration cancel1ed by the Director but retaining their pen­

sion rights under the National Insurance Act, 19 56.".

4. For paragraph (3) of regulation 25 of the principal regulations

there s ha ll be substituted the following

"(3) The provisions of paragraphs (l) and (2) of this regula­

tion shall not apply to a port worker

(a) who retired from port work during the five year

period ended on the fourth day of April, 1973, and who during

that sa me period was replaced by a son or brother;

(b) who has reached the retiring age on or after the fifth

day of January, 1980.".

5. Immediately after paragraph (2) of regulation 26 of the prin­

cipal regulations there shall be added the following new paragraphs

"(3) The provisions of sub-paragraph (c) of paragraph (1) and

of sub-paragraph (b) of paragraph (2) of this regulation shall not

apply to port workers who after the twenty-second day of January,

1979, have their licence cancelled under the provisions of this regu­

lation, if they reach the retiring age on or after the fifth day of

January, 1980, saving their pension rights under the National

Insurance Act, 1956.

Saving the provisions of paragraph (3) of this regulation,

a person who is registered as a port worker after the thirtieth day of

May, 1978, sh a ll not be eligible to receive a pension as specified in

paragraphs (1) and (2) of this regulation if he does not satisfy the

requirements laid down in regulation 27 of these regulations.".

6. In regulation 27 of the principal regulations, for the words

"Notwithstanding the provisions of regulations 24 and 26, and saving

the provision of regulation 29, of these regulations" there shall be sub­

stituted the words "Saving the provision of regulation 29 of these regu­

lations -

".

Schedule 4 of the p rincipal regulations shall be amended as fol­

(a) for the figure "f550" in paragraph 1 thereof there sħall be

"f5S0" in column 2 of paragraph 2, and of sub-paragraph (i) of

paragraph 6 thereof there shall be respectively substituted the

figures "±:J16", "f232", "f348", "f464" and "f580"; and

(c) for the figures "f358" and "±:246" in column 2 of parag­

raph 7 thereof, there shall be respectively substituted the figures

"f377" and "f259".
