MALTA ARMED FORCES ACT, 1970

(ACT NO. XXVII OF 1970)

The Armed Forces of Malta (Regular Force) (Appointments and

Conditions of Service) (Amendment) Regulations, 1980

IN exercise of the powers conferred by section 4 of the Malta

Forces Act, 1970, and all other powers him enabling, the

President of Malta has made the following regulations:-

These regulations may be cited as The Armed Forces of Malta

(Regular Force) (Appointments and Conditions of Service) (Amend­

ment) Regulations, 1980, and shall be read and construed as one with

pr i nci p al regulations".

For regulation 24 of the principal regulations there

shall be

substiluted the following:-

Successful candidates shall be enlisted -

(1)

(a} on an initial engagement of three years with

the colours to count from the da te of attestation or the

eighteenth birthday whichever is the later, or

(b)

on a five year engagement with the colours to

count from the date of attestation, or

(c)

where a man enlists on secondment from the

public service, on a three year engagement with the

colours to count from the date of attestation,

the Minister may determine

Provided that the engagement shall

be deemed to be

completed -

(i) in the case of candidates who are enlisted

a five year engagement but are over fifty-five

on

years of age on the date of enlistment, on their

attaining the age of sixty-one years or on comple­

tion of the said period of engagement whichever is

the earlier; but such candidates may opt to term i­

nate their engagement on attaining the age of sixty

years;

(ii)

in the case of candidates who are en1isted

on a three year engagement on secondment from

the public service, on the date on which they are re­

called to the public service.

(2) There shall be no reserve liability and no ter-

minal benefits on completion of -

(a)

the initial engagement of three years, or

(b)

the five year engagement, or

(c)

the three year engagement,

referred to in paragraph (l) of this regulation.".

3. For the First Schedule to the principal r egulations there shall

be substituted the following

(i) immediately after paragraph 6 of the Notice Paper under

regulations.

Part I there shall be added the following new paragraph

"6A.

For men enlisting on a three year engagement -

Y ou wilI be enlisted on a three year engagement,

but, if you are recaIled to the public service, the engage­

ment will be deemed to be completed on the day on

which you are so recalled.";

(ii)

immediately after sub-paragraph (c) of Question 16 of

the Notice Paper under Part I there shall be added the folIowing

new sub-paragraph

"(d) A teml of three years, or, if you are recalIed to the

public service, up to the date on which you are so recal1ed.";

(iii) immediately after sub-paragraph (c) of Question 16 of

the Attestation Paper under Part II shall be added the following

new sub-paragraph

"(d) A term of three years, or, if you are recalled to the

public service, up to the date on which you are so recalled.",

and

(iv) for the Oath to be taken by recruit on Attestation in the

Attestation Paper under Par t 11 there shall be substituted the

fol1owing
