Port Rates (Amendment) RegUllations, 1980

IN exercise of the powers conferred by section 42 of the Parts

Ordinance, 1962, the Minister of Development, Energy, Ports and Tele­

communications, with the concurrence of the Minister of Finance, Cus­

toms and People s Financial Investments, has made the following regu­

lations

These reguIations may be cited as the Port Rates (Amend­

ment) Regulations, 1980, and shall be read and construed as one with

the Port Rates Regulations, 1969, hereinafter referred to as "the prin

­

cipal regulations".

In Part II of the Second Schedule to the principal regulatlons,

for the words "2c2 for every hundredweight or twa cubic feet, which­

ever is the greater, or part thereof" there shall be substituted the words

"4c for every 50 kilograms or 5663 cm3, or part thereof, whichever

shall be the greater amount".

Immediatdy after pa r ag r aph i of Par t I of the Seventh

Schedule to the principal regulations there sha11 be added the fol1owing

new paragraph

"IA. Notwithstanding the provisions of paragraph 1 of this

Part, when any unit load or unitised cargo, specified in Column 1

of the Table hereunder, is unloaded from a ship and such cargo is

handled by the Director of Ports or his contractor between ship's

ramp or door ar ship's rail, as the case may be, and quay or ware­

house, t he r e shaH be paid to the Directcr of Ports or his contractor,

as the case may be, in addition to any other charges which may be

due under these regulations, the relative rate shown in Column 2 of

the said Table

a ship and such cargo is handled by the Director of Ports or his

may be, and quay or warehouse, there shall be paid to the Director

of Ports or his contractor, as the case may be, in addition to any

other charges which may be due under these regulations, the rela­

tive rate shown in Column 2 of that Table.".

q;:, Paragraph 1 of Part III of the Seventh Schedule to the princi­

pal regulations s h all be amended as follows

(a) for the figures "f 1.22,0" , "f1.86,0", "f2.42,0" and

"B.OO,O" sholVll in the Table thereunder there shall be substituted

respectively the figures "28c", "90c", "120c" and "200c", and

(b) immediately after the proviso thereto there shall be added

the following new proviso

"Provided further that, when the number of motor

vehic1es, unpacked and mobile, unloaded from, and/or loaded

on, the sam e ship in one single operation exceeds 500 units, the

rates specified in item (b) of the above Table shall be reduced

by 50 per centum." .

4. Fil-paragrafu 2 tat-Taqsima I tas-Seba' Skeda li tinsab mar-re-

golamenti prinċipali minflok il-kliem "paragrafu l" għandhom jidħlu

l-kliem "paragrafu l jew IA".

5. Minnufih wara l-paragrafu 1 tat-Taqsima II tas-Seba' Skeda li

tinsab mar-regolamenti prinċipali għandu jiżdied il-paragrafu ġdid li ġej

"IA. Minkejja d-disposizzjonijiet tal-paragrafu 1 ta' din it­

Taqsima, meta xi tagħbija f'unita waħda jew merkanzija miġbura

f'unita waħda, speċifikata fil-Kolonna 1 tat-Tabella għall-paragrafu

IA tat-Taqsima I ta' din l-Iskeda, tkun mgħobbija fuq bastiment u

dik il-merkanzija tkun maniġġata mid-Direttur tal-Portijiet jew mill­

kuntrattur tiegħu bejn ir-rampa jew il-bieb jew il-muratura ta' basti

ment, skond il-każ, u l-moll jew il-maħżen, għandu jitħallas lid-Di­

rettur tal-Portijiet jew lill-kuntrattur tiegħu, skond il-każ, b'żieda

ma' kull ħlasijiet oħra li jistgħu jkollhom jitħallsu taħt dawn ir­
