Regulations, 1980

IN exe r c ise of the powers conferred by se ction 12 of t he Guest

Houses and Holiday F u r n ish ed Premises Act, 1974, t he Minister of

To u r i s m , with the concurrence of the Minister of Finance, Customs a nd

P eo p l e ' s Financial Investments, has made the following regulations:-

These regulations may be cited a s t h e G u e s t H ous es a nd

Holi da y Furnished Premises (Amendment) Regulations, 1980. and shall

be read and construed as one wi t h the Guest H ous es a n d H olid ay

Fumished Premises Regulations, 1976, h e r ei n af ter referred to as "the

pr i n cip a l regu la tio n s ".

For regu l a t io n 6 of t h e principal regulations the r e shall be

substituted the fol1owing

"6. (l) There shall be pai d to the Board in respect of every

application made and every certificate and licence issued, renewed

or transferred u n der the Act, other than a licence issued under

section llA, the appropriate fee specified in Part I of the Eighth

Schedule to these regulations.

(2) Whenever a n ew licence is issued by the Board after

the fir s t day of July of a n y year, the fee for such licence shall be

one half of the an n ua l rate a ppl i c a bl e for such li ce n c e .

(3) Whenever. du ring the term of v al i d it y of a l i c en c e ,

a gu es t house or holiday premises is reclassified in a c l a s s higher

to the one shown on the licence, the B o a r d shall issue a new lic e n c e

accordingly.

(4) In any case fal1ing under the pro vi sio ns o f p a r ag r a ph

(3) of this regu lat ion there shall be deducted f ro m the a p p r o priate

,

fee p a y a ble in r e sp e ct of the new licence, the fee p a id for the

pre vi ou s li cence

Provided that such deduction shall be equal to one ha1f of

the fe e p a i d in respect of the previous licence if t he new licence is

i s s u ed after the first d a y of July of the same year.

(5) There shal l be p a i d to the M i n ist e r for a licence

issued under se ction IlA o f the Act the a p propri ate fee specified

in Pa rt II o f the Eighth Schedule to these re gulat io n s .

(6) Notwithstanding the pr ov is i o n s o f p a r a g r a p h (1) of

this regulation, from the annual l ice n ce f ee l evie d b y and p aya b l e

to the B oa rd in r e s p e ct of any h o l id ay premises, the r e shall be

paid to the N a ti o n a l Tourist Organisation such sum as t h e Minister,

with the concurrence of the Minister r es po ns ible for f i na n c e , may

from time to time deem proper, as contributio n to the said Organi­

s a ti o n , in terms and for the purposes of s ub s e c t ion (3) of section

5 of the Act.".

In regulation 17 of the principal regulations, for the words "by

the Chairman of the Board" there shall be substituted the words "by the

Minister or by the Chairman of the Board".

In regulation 20 of the principal regulations, for the words "ten

pounds" there shall be substituted the words "fifty pounds".

Immediately after the Seventh Schedule to the principal regula­

tions there shall be added the following new Schedule

Provided that in each case the above annual licence fee

shall be increased by flO for every additional bedroom in excess of

the first three:'.

The Guest Houses and Holiday Furnished Premises (Licences,

Certificates and Appeals) (Fees) Regulations, 1976, are hereby revoked.
