Skips (Pieti't LocaJ Council) Rye-Laws, 1996

IN exercise of the powers conferred by sections 34 and 60 of the

Local Counci ls Act. 1993, and in conformity with the provisions of

subsection (8) of section 35 of this Act . the Pic t~ Local Council has

made the following Bye-Laws:-

1 These Bye-Laws may be cited as the Skips (Piela Local

Council) Bye-Laws. 1996.

These Bye·Laws shal l come into force one month after their

publ ication in the Gazette .

In these Bye-Laws. unless the context otherwise requires: -

2. "Authorised Person" means any person holding a pennit or

his represe ntative and any reside nt of any street or pan thereof

who is the only person au thorised in accordance with subsection

4.2 of these Bye-Laws

"bin on wheels" means any recipient on wheels that may be

closed by means of a lid. used for the deposit of domestic refuse,

supplicd by or undcr the authority of the Council and placed in a

public place within the Pieta locality boundary. but does not include

skip;

"commercia! and/or industrial waste or refuse" means any

waste, originating from any shops. factories.ente rprises.companies

and other entities operating in commerce and industry IInd includes

all bulky refuse in general. but does not include domestic waste or

refuse;

"Council" means the Pieta Local Council;

"domestic refuse" means household waste originating from

private dwellings including fiats or residential homes but does not

include commercial and/or industrial waste;

"skip" means any open or closed skip supplied by or under

the authority of the Council in a public place within the Piela locality

boundary, and which includes any OI:her recipient of this kirK!. used

for the deposi t of commercial and/or indusuial waste. but does not

include bin on whecls.

3. A Skip or bin on wheels may only be used by authorised Pe...,.. 10 "~ 'kl p

persons.

4 .. 1 No person, OIher than the Council . shall have the power to I'nw1:.- '" place

place any skip or bin on wheels in any public place within the Pieta ""

locality boundary.

4 .2 The Council may assign an area wherein authorised persons

only may use skips or bins on wheels provided by the Council in lieu of

door· to-door collection of domestic and commercial waste.

4 .3 The Council may however, authorise in writing any person

to place a skip or bin on wheels during such times and at such places

and unde r such tenns and conditions as may be stipulated in the written

authority by the Council annexed in Schedule A to these 8ye-Laws.

4.4 There shall be payable on application to the Council by the

perso n granted an authority under this section a fee of: -

fifty cents per day for every skip

4.4.1

ten cents per day for every bin on wheels.

4 .4 .2

4.5 An y person who contravenes any provision of this section or

who fai ls to comply with any of the conditions stipulated in the written

authority . shall be guilty of a contravention .

5. No person shall:-

5.1 make use of any skip or bin on wheels unless he is an

authorised person; or

5.2 cause any da mage 10 any ski p or bin on wheels or

obliterate tiny markings printed on or affixed thereon; or scribble

or make any mark on any skip or bin on wheels without the consent

of the Council or of the person to whom authority has been granted

10 place a skip or bin on wheels by vi rt ue of section 4 of these

Bye-Laws as the case may require: or

5.3 after using the skip or bin on wheels leave its lid open

or ajar: or

5.4 use the skip or bin on wheels for an y purpose other than

that it is intended for: or

when the skip or bin on wheels is full. deposit any refuse

or waste in a manner thallhe lid of the skip or bin on wheels will

nol dose properly or will re main ajar; or

5.6

when depositing such waste or refuse . spill and leave

spilled any waste or refuse outside the skip or bin on wheels; or

5.7

throw or deposit any waste or refuse ncaror around the

skip or bin on wheels; or

5.8 deposit in any bin on wheels any waslc, refuse. object

or substance which is not of a domestic nature: or deposit in any

skip any commercial or industrial waste for which au thority was

not granted under the wriuen authority in accordance with these

Bye-Laws; or

5.9 deposit in the skip or bin on wheels any bulky article or

liquid o r any refuse, object or substance which the skip is not

intended to recei ve; or

5.10 remove or misplace the skip or bin on wheels from

where it is placed unless, fn the case of a skip or bin on wheels

placed under the authority of the Council by a person , such person

shall have obtained authority in writing 10 do so from the Council;

5.11 deposil waste or refuse in a skip orbin on wheels which

is nOl supplied by the Council but placed by a person 10 whom

authority has been granted by the Council in IlCcordance with these

Bye-Laws; or

5.12 after the 1st January 1997. deposit in a bin on wheels

any domestic refuse which is nOt contained in a closed bag. of a

type and material approved by the Council; or

5.13 in the case of a skip, deposit therein industrial and/or

commercial waste or refuse which does not originate from within

the Pieta locality boundary, unless under the authority in writing

of the Council and against registration or payment as the case may

be of a fee as shown in Column 2 of Schedule B to these Bye-

Laws; or

5.14 when authorised by the Council to deposit waste or

refuse in a particular skip or bin on wheels deposit any waste or

refuse in another skip or bin on wheels.

under Column 1 of Schedule B to these Bye-Laws, shall register with

the Council in order to be granted authority to deposit commercial

and/or industrial waste in the skips supplied by the Council in the

PietA locality boundary.

6.1.1 Without prejudice to the provisions of article

6.1 above, every person in Category I of Schedule B of these

8ye-Laws can dispose o f commercial and/or industrial waste in a

bin on wheels.

6.2

For each registration made under sub-section 6. 1 a fee as

shown in Column 2 of Schedule B to these 8ye-Laws shaH be payable

to the Council.

6.3 The Council may, for 8 valid reason given in writing. refuse

to register a person under sub-section 6.1 above.

6.4 No person shown in Column I of Schedule B to these Bye-

laws shall throw or deposit commercial and/or industrial waste in the

skips supplied by the Council in the PietA locality boundary unless

payment of the fee due undcr Column 2 of Schedule B 10 these Bye-

Laws is made on registration.

7.1 Without prejudice 10 the provisions of sub-sections 7.2 and orr.neu .....

any of the proviSions of section 5 hereof shall be deemed to have

committed a contravention and shall ,on conviction, be liable, unless a

higher penalty is applicable under any other law -

7.1.1 for a first contravention loa fine (ammenda) of twenty

Maltese liri , and

7.1.2 for a second or subsequent contravention 10 a fine

(ammenda) of thirty Maltese liri.

7.2 In the case of a contravention unde r section 4 of these Bye-

Laws. a person shall be liable on conviction to a fine (ammenda) of

thiny Maltese liri. and in the case ofa continuing offence. to a further

fine (ammenda ) of fi ve Maltese liri for each day during which the

offence continues.

7.3 In the case of a contravention under section 6.4 of these

Bye-Laws a person shall be liable on conviction to a fine (ammenda)

of thirty Maltese liri .

7.4 ne imposition of a penalty under this section shall be withoUl

prejudice 10 the right of thc Cooncillo recover any civil damages caused

by the commission o f any contta ... cntion under these Bye-Laws.

8. The Counci l may terminate the authority given or cancc:11he

registnllion made under these Bye-Laws if it is satisfied thal any o f the

temlS and conditions under which the said authority was gran ted or

registration made has nol been complied with.or i f there is a substantial

change in ci rcumstances which in the opinion of the Council renders it

necessary to withdraw the au thori ty or cancel the registration. In this

case Ihe Council shall not be obliged to refund any fee that would have

already been paid 10 the Council under Schedule B to these Bye-Laws.

The skiplbin on wheels shall be of a size , type an d colour 10 be approved in

writing by the Council.

No markings shall be printed on or affixed to or removed from the skiplbin on

There shall be printed on the skiplbin on wheels such markin gs as may be indicated

3. by the Council in Writing.

The skiplbin on wheels shall be placed on the silels indicated by th e Council on

4. the attached site plan provided by the same Council.

The authorised person shall ensure that the skiplbin on wheels is emptied every

5. _ _ _ _ or when it is fu ll. whichever is the earlier.

The Skips (Pietll Local Council) Byc-Laws. 1996 shall apply to each and every

6. skiplbin on wheels placed in the Pieta locality boundary.

The au thorised person has to ensure that all preventive precautions for the

7. conservation of the environment and for the protection of the citizen, are being

implemented .

8. The authorised person must apply for an adequate insurance policy, acceptable

to the Council, against third party liability and indemnify the Council agai nst

any claims arising out of. or in relation to. the placement or use of any such

skiplbin on wheels .
