Outdoor Activities within the Locality of Mellieħa (Mellieħa Local

Council) (Amendment) Bye-Laws, 2020

IN EXERCISE of the powers conferred by article 34 of the Local

Government Act, the Mellieħa Local Council has made the following

Bye-Laws:-

The title of these Bye-Laws is the Outdoor Activities

within the Locality of Mellieħa (Mellieħa Local Council)

(Amendment) Bye-Laws, 2020 and these bye-laws shall be read and

construed as one with the Outdoor Activities within the Locality of

Mellieħa (Mellieħa Local Council) Bye-Laws, hereinafter referred to

as "the principal bye-laws".

Bye-law 2 of the principal bye-laws shall be amended as

follows

(a) in the definition "application", the word "Fifth" shall

be substituted by the word "Sixth"; and

(b) immediately after the definition "locality" there shall

be added the following new definition

" "motor vehicle" shall have the same

meaning as that given to it in the Traffic

Regulation Ordinance".

Bye-law 3 of the principal bye-laws shall be amended as

follows

(a) in bye-law 3.1.1. thereof, the words "no person may

erect a camp or undertake catering activities in any place within

the locality including in any designated beach, without the prior

written authorisation of the Council given in terms of these Bye-

Laws and the conditions stipulated in the permit issued:" shall be

substituted by the words "no person may erect a cap, caravan or

undertake catering activities in any place within the locality

including in any designated beach, without the prior written

authorisation of the Council given in terms of these bye-laws and

the conditions stipulated in the permit issued, which conditions

shall be considered as part of these bye-laws. These permits are

subject to and shall be read in conjunction with the provisions of

all the Regulations and conditions stipulated in the Trees and

Woodlands Protections Regulations.";

(b) in bye-law 3.1.1. thereof, immediately after

paragraph (c) there shall be added the following new provisos

"Provided that no motor vehicle, or caravan

shall be parked in Zones designated as camping areas A, B

and C, as indicated in the First Schedule

Provided further that no campers or caravans

shall be parked in the locations indicated in the Fifth

Schedule to these bye-laws;";

(c) in bye-law 3.1.2. thereof, immediately after the words

"cooking at the beaches indicated in the" there shall be added the

words "First and"; and

(d) in the proviso of bye-law 3.1.2. thereof, the words "at

the beaches indicated in the Third Schedule" shall be substituted

by the words "at the beaches and designated camping areas

indicated in the First and Third Schedule".
