IN exercise of the powen conferred by section 34 of tile Local

Councils AC1 , 1993, and in ronformity with the provisions of subsection

(8) of section 35 of this Act, the Hamrun Local Council has made the

following Bye-Laws: -

1 These Byc-Laws ma y be cited as the Skips (tlamrun Loc:al

Council) Bye-Laws , 1994.

1.2 These Bye-Lawli shall come into force onc month ahcr their

publication in the Gazelle.

In tliese Bye-Laws. unlcss lhe context olhe~ requires:-

-Couocil~ means the Hamn.llll.oaol Cou ncil;

~domeslic rC'fuse- means household Walte from private

d ..... ellings incl uding flats or ~sidcntial homes. btu does not include

w;lSlc or refuse of a romrnercial or industrial nalu re;

~skipM means any skip supplied by or under the authority of

1~ Council and placed in a public place within the H amrun locality

boundary, and includes skips intended to be used by the public for

tn., deposit of domestic refuse.

1. No perwn, other than the Cou ncil, shaLl have l>O"'er to place

any skip in any public pla~ within the Mamrun 1000ality bollndary .

3,2 The Council may however authorise in writ;nl any person to

place a skip durinl ~uch times and al ~lIch places .nd under such other

terms and condi tiom as may be stipulated in the wri tten au thority

anne~ed in the Schedule to these Bye·Laws.

3.3 There ~hall be payable On application to the Council by the

person granted an autbority under this section a fee of 4Occn1$ per day

for every skip.

3. 4 Any person .... ho contravenes any provision of th is article. or

.... ho fails to comply " 'jth any of the conditions stipul ated in the ;"'ritten

No person shall:-

4. 1 cause any damage to any skipor obliterate any markings

printcd on o r affi~ed to any skip ; or

4,2 after using the skip. leave its lid open ; or

use Ihe skip for any purpose other Ihanlhat it is intende!.l

4.3

for; or

4.4 when the skip;$ full, deposit any refuse in a manne r that

the lid of the skip will not close properly; or

4.S when depositing such refuse, spill any refuse outside the

skip; or

4.6 throw or okposit any refuse ncar the skip; or

4.1 deposit in the skip any refuse. object or substance which

is not of 8 domestic nature: or

4.8 deposit in the skip any bulky article, or liquid, or any

refuse . object or substa no:<: which the ski p is not intended 10

receive: or

4.9 remove the sk ip from w!>e,e il is pIaocd: 01

4. 10 3fte, the 1 January , 1996, deposit in a skip any refuse

which is not contained in a closed bag. of a type and mate rial

approved by the Council.

5.2 In the case nf a contravention under s.e<:tlnn 1 nf these Bye:-

5.l The impositinn nf a penalty under this sectinn stlaH be withnut

prejudice Inlne right nf the Council In l"eCOvt:ranycivil damagescauscd

by the commissinn nf the contraventinn under these 8 ye-Laws.

Th e Council may terminate the authnrity given in terms of

theiIC 8 ye·Laws if it is !>3tislied that any of the terms and conditinns

under which the said authority wasg;ven has not been complied with nr

if there is a sub$tall1ial change in ci rcumstances whictl in ttle npinion of

The skip shall be of a 5ize . type and colour 10 be approved in writing by the Council.

1. No markings shall be printed o r .ffil<cd to the skip unless .... thoriscd by the Council

in writing.

There shan be printed or affllled to the skip such markinp as may be indialled by

4. The skip/I shan be placed on the l itelsindica ted by the Council on lhealladiedsile

plan provided b y the same Council.

S. The a uthorised person $hall cause the s.kip to be emptied cv<:ry

or when it is full. whichever is th e earlier .

6. The Skips (H am ..... n Local Council) Bye· ..... ws, 1994 shall apply with rcspecl to all

skiplO within the Hamrun locality .

The authorised person shaHlato: 0111 an adequate insurance policy, acceptable to

the CollndJ , against third party liability and to indemnify the Council against any
