ACT No. XXIX of 2021

AN ACT to further amend the Criminal Code, Cap. 9.

BE IT ENACTED by the President, by and with the advice and

consent of the House of Representatives, in this present Parliament

assembled, and by the authority of the same as follows:-

The short title of this Act is the Criminal Code (Amendment Short title.

No. 6) Act, 2021 and this Act shall be read and construed as one with Cap. 9.

In sub-article (3) of article 412A of the Code for the words Amendment of

"provided that the provisions of this sub-article shall not apply" there article

shall be substituted the words "provided that the Court may decide not

to apply the provisions of this sub-article or not to apply them to their

full extent".

Article 579 of the Code shall be amended as follows

(a) in the proviso to sub-article (1) thereof for the words

"Provided that this article shall not apply" there shall be

substituted the words "Provided that the Court may decide not to

apply the provisions of this sub-article or not to apply them to

their full extent"; and

(b)

in sub-article (2) thereof for the words "and the sum

stated in the bail bond shall be forfeited to the Government of

Malta." there shall be substituted the words "and the Court shall

order that the sum stated in the bail bond shall be forfeited in full

or in part to the Government of Malta according to the Court’s

assessment of the gravity of the offence.".
