ACT No. LII of 2020

AN ACT to further amend the Criminal Code, Cap. 9.

BE IT ENACTED by the President, by and with the advice and

consent of the House of Representatives, in this present Parliament

assembled, and by the authority of the same, as follows:-

The short title of this Act is the Criminal Code (Amendment Short title.

No. 3) Act, 2020 and this Act shall be read and construed as one with

the Criminal Code, hereinafter referred to as the "Code".

In sub-article (2) of article 87 of the Code, the words Amendment of

Sub-article (1) of article 328F of the Code shall be amended Amendment of

in terrorist activities" there shall be added the words "or of a

terrorist group"; and

(b) the words "the punishment of imprisonment for a

term not exceeding four years or to a fine (multa) not exceeding

eleven thousand and six hundred and forty-six euro and eighty-

seven cents (€11,646.87) or to both such fine and imprisonment."

shall be substituted by the words "the punishment of

imprisonment for a term of not less than four years but not

exceeding twenty years or to a fine (multa) not exceeding two

million and five hundred thousand euro (€2,500,000) or to both

such fine and imprisonment.".

In sub-article (1) of article 328G of the Code, the words "be

liable to the punishment of imprisonment not exceeding twelve years."

shall be substituted by the words "be liable to the punishment of

imprisonment from seven years to life.".

In sub-article (1) of article 328J of the Code, the words "be

liable to the punishment of a fine (multa) of not less than eleven

thousand and six hundred and forty-six euro and eighty-seven cents

(€11,646.87) and not more than two million and three hundred and

twenty-nine thousand and three hundred and seventy-three euro and

forty cents (€2,329,373.40)." shall be substituted by the words "be

liable to the punishment of a fine (multa) not exceeding five million

euro (€5,000,000).".

In sub-article (1) of article 492 of the Code, the words

"punishment of imprisonment for a term from eighteen to thirty years."

shall be substituted by the words "punishment of imprisonment for a

term from twelve to forty years.".
