ACT No. XLV of 2016

AN ACT to amend or repeal various laws.

BE IT ENACTED by the President, by and with the advice and

consent of the House of Representatives, in this present Parliament

assembled, and by the authority of the same, as follows:-

The short title of this Act is the Various Laws (Amendment Short title.

and Repeal) Act, 2016, and the provisions of this Act shall be read

and construed as one with the various laws which are amended or

repealed thereby.

Part I

Amendments to the Code of Organization

and Civil Procedure

This Part amends the Code of Organization and Civil Amendment of

Procedure and it shall be read and construed as one with the Code of the

Organization

Organization and Civil Procedure, hereinafter in this Part referred to and

Procedure.

as "the Code".

Article 157 of the Code shall be substituted by the Substitution of

article 157 of

following

the Code.

"157. It shall be the responsibility of the plaintiff to cause

a copy of the sworn application, any affidavit of the plaintiff and

of the documents attached with the application to be served on

the defendant, and such service shall be effected through the

Registrar.".

Immediately after sub-article (1) of article 319 of the Code,

there shall be added the following new sub-articles

"(1A) The auction shall commence at the time established

by the Court and shall continue until the highest public bid is

adjudicated.

(1B) The sale of different items to be sold by auction

may be held during the same time, each one separately and in

consecutive order.".

Immediately after paragraph 8 of Tariff A of Schedule A to

the Code, there shall be added the following new paragraph

"8A. There shall be charged by the Registrar of Courts, in

respect of the publication of a court notice in the Gazette,

irrespective of the length of such notice, a fee of four euro and

sixty-six cents (€4.66).".

In sub-paragraph (4) of paragraph 5 of Tariff D of

Schedule A to the Code, for the words "Provided further that when a

licensed auctioneer performs the auction, the fee established in the

Auctioneers Act shall, in addition be due to the auctioneer.", there

shall be substituted the following

"Provided further that when a licensed auctioneer or

broker performs the auction, such licensed auctioneer or

broker shall be paid the following fees

(a) in the case of an

auction

of

immovable

property, of rights annexed

to

such

immovable

property, of ships and of

commercial going concerns zero point two per cent of

the price of the item sold,

solely from the applicant on

whose demand the judicial

sale is made; and

(b) in the case of an

auction of movable items ... zero point one per cent of

the price of the item sold,

solely from the applicant on

whose demand the judicial

sale is made

Provided further that the parties may, in writing,

agree that the licensed auctioneer or broker, as the case

may be, be paid different fees, not being less than those

provided for in paragraphs (a) and (b), and in such

proportions as they may so agree in writing.".

Part II

Repeal of the Old Privileges and Hypothecs

(Registration and Renewal) Ordinance

The Old Privileges and Hypothecs (Registration and Repeal of the

Renewal) Ordinance is hereby repealed, without prejudice to Old

and Hypothecs

anything done or omitted to be done thereunder.

Part III

Revocation of various subsidiary legislation

Notwithstanding the provisions of any other law, the Revocation of

subsidiary legislation listed in article 9 shall be revoked by virtue of subsidiary

legislation.
