An Act to amend various laws relating to the functions of

Members of Parliament

BE IT ENACTED by the President, by and with the advice and

consent of the House of Representatives in this present Parliament

assembled, and by the authority of the same as follows:-

The title of this Act is the Functions of Members of

Parliament (Various Laws) Amendment Act, 2013.

In sub-paragraph (ii) of paragraph 13 of the Second

Schedule to the Auditor General and National Audit Office Act the

words "the Minister responsible" shall be substituted by words "the

Minister or any another Member of the House of Representatives

responsible".

Sub-article (5) of article 4 of the Malta Crafts Council Act

shall be substituted by the following

"(5) A person shall not be eligible to be a member of the

Council if he has been convicted of any

(a)

crime against property and public safety;

(b)

crime against public trust;

(c)

crime against public trade; or

(d)

offence under the Trade Descriptions Act.".

Paragraph (a) of sub-article (5) of article 8 of the Amendment to

Occupational Health and Safety Authority Act shall be substituted by the

"(a)

is a Minister or a Parliamentary Secretary; or".

Sub-article (3) of article 4 of the Co-operative Societies Amendment to

the Co-operative

Act shall be substituted by the following

Societies Act.

"(3) No person shall be appointed or shall remain a

member of the Board if that person is an officer or member of

any society or the Apex organization.".

Paragraph (a) of sub-article (6) of article 4 of the Sports Amendment to

Act shall be deleted and paragraphs (b), (c), (d), (e) and (f) shall be the

Sports Act.

re-numbered as paragraphs (a), (b), (c), (d) and (e) respectively.

Paragraph (a) of sub-article (7) of article 10 of the Malta Amendment to

Enterprise Act shall be deleted and paragraphs (b), (c), (d), (e) and (f) the

Malta

respectively.

Sub-article (2) of article 9 of the Malta Language Act shall Amendment to

Council or of any of its organs if he is a Judge or Magistrate.".

Paragraph (a) of sub-article (5) of article 3 of the Malta Amendment to

Sub-article (2) of article 3 of the Domestic Violence Act Amendment to

the Domestic

"(2) A person shall not be qualified to hold office as a

member of the Commission if he is a Minister or a

Parliamentary Secretary.".
