ACT No. XIII of 2008
AN ACT to amend the Commercial Code, Cap. 13.
BE IT ENACTED by the President, by and with the advice and
consent of the House of Representatives, in this present Parliament
assembled, and by the authority of the same, as follows:-
(1) The short title of this Act is the Commercial Code Short title.
(Amendment) Act, 2008 and this Act shall be read and construed as
one with the Commercial Code, hereinafter referred to as “the Code”. Cap. 13.
(2) This Act shall come into force on such date as the Minister
for Justice and Home Affairs may by notice in the Gazette appoint.
The words “Chamber of Commerce”, wherever they occur General
in the Code, shall be substituted by the words “Chamber of amendment.
Commerce, Enterprise and Industry”.
In article 79(2) of the Code, the word “merchants” shall be Amendment of
article 79 of the
substituted by the words “suitable persons”.
Code.
Article 119(1) of the Code shall be substituted by the
following new sub-article
“(1) The Chamber of Commerce, Enterprise and Industry
is a body composed of traders, brokers, master-mariners and all
other persons engaged in trade, commerce or industry.”.
Article 120(2) of the Code shall be substituted by the
following new sub-article
“(2) The said Council shall represent the commercial,
mercantile and industrial community of Malta.”.

(2) Dan l-Att għandu jidħol fis-seħħ f’dik id-data li l-Ministru
tal-Ġustizzja u l-Intern jista’ b’avviż fil-Gazzetta jistabilixxi.
2. Il-kliem “Kamra tal-Kummerċ” kull fejn jidhru fil-Kodiċi, Emenda
għandhom jiġu sostitwiti bil-kliem “Kamra tal-Kummerċ, Intrapriża u ġenerali.
Industrija”.
3. Fl-artikolu 79(2) tal-Kodiċi il-kelma “kummerċjanti” Emenda ta’ l-
artikolu 79 tal-
għandha tiġi sostitwita bil-kliem “persuni xierqa”.
Kodiċi.
4. L-artikolu 119(1) tal-Kodiċi għandu jiġi sostitwit bis- Emenda ta’ l-
artikolu 119 tal-
subartikolu ġdid li ġej
Kodiċi.
“(1) Il-Kamra tal-Kummerċ, Intrapriża u Industrija hija
korp ta’ kummerċjanti, sensala, kaptani tal-baħar u kull persuna
oħra li tkun fin-negozju, fil-kummerċ jew fl-industrija.”.
5. L-artikolu 120(2) tal-Kodiċi għandu jiġi sostitwit bis-
subartikolu ġdid li ġej
“(2) Il-Kunsill imsemmi għandu jirrapreżenta l-komunità
kummerċjali, merkantili u industrijali ta’ Malta.”.
