ACT No. XVIII of 2005

AN ACT to amend the Patents and Designs Act, Cap. 417.

BE IT ENACTED by the President, by and with the advice and

consent of the House of Representatives in this present Parliament

assembled, and by the authority of the same, as follows>-

(1) The short title of this Act is the Patents and Designs Short title and

commencement.

(Amendment) Act, 2005 and it shall be read and construed as one with

the Patents and Designs Act, hereinafter referred to as “the principal

Act”.

(2) The provisions of this Act shall be deemed to have come

into force on the 1 st January, 2005.

In sub-article (2) of article 26 of the principal Act, for the Amendment of

words from “Such maintenance fee” to the words “prescribed due date.” article

there shall be substituted the words “Such maintenance fee shall be due

in respect of the third year and each subsequent year thereafter calculated

from the filing date of the application and shall be paid by not later than

the last day of the month of the prescribed due date.”.

In the Maltese text of sub-article (1) of article 98 of the principal Amendment of

article 98 of the

Act, for the words “ti;i dikjarata valida” there shall be substituted the principal Act.
