AN ACT to amend the Social Security Act.

BE IT ENACTED by the President, by and with the advice and

consent of the House of Re presentatives, in this present Parliamen t

assembled , and by the authori ty of the same, as follows:-

(1) This Act may be cited as the Social Security (Amendment)

Act, 1997 ,and shall be read and construed as one with the Social Security

Act , hereinafter referred to as "the principal Act".

(2) This Act shall be dcc:med to have come into force as

(a) sections 7 to 11, 13 and 14 shall be dee med to have

come into force on the 4th January , 1997; and

section 12 shall be deemed to have come into force on

(b)

the 6th Jan uary, 1997; and

(e) sections 2 to 6 shall come into force on the 4th October,

1997 .

In subsection (1) of section 2 of the principal Act. for the

definition of"Scrvice Pension" , there shall be substituted tbe following:-

""Service Pension", means-

(i) with effect from the lstdayof April, 1978,apension

or otber allowance awarded to a pen<m at any time before or

Arter the aforesaid date that is payab le by or Oil behalf of his

employer in respect of past services in M alta or abroad and

shall in each and every case be considercd on an ullcommuted

basis , and

(ii) with effect from January 6, 1996. net of increa.o;es

in the amount payable of such Service Pension by way of

cost of living increases awarded after January 7 , 1995, and

(iii) with cffect from October 4, 1997, a pension or

other allowance, otherthan a pension or other allowance which

has bcen commuted in whole, or which does not exceed

Lm200 per annl,lm, net of increases in the amount payable of

such Service Pension by way o f cost of living increases

awarded aftcr the initial award of su.ch.service Pcnsion

Provided that, witll effect from the 4th January, 199'2,

where such person is in receipt of two or more Service

Pensions, only the higher or the highest, as the case may be ,

of such Scrvicc Pensions shall be "deemed to be a Service

Pension for the purpose of assessing, revising or re-assessins

a pension in respect of retirement or invalidity under this Act

sohowever that , and solely for the purpose of assessing,

~vising or re-assessing a Retirement Pension in accordance

with section 44 and paragraph (i) of subsection ( 1) of section

47 of this Act, a person who is in receipt of two or more such

Service Pensions one of which is payable by or all behalf of

the United Kingdom Government.shall have the ri ght to elect

which of such Scrvice Pension as aforesaid is to be deemed

to be the Service Pension for this Ilitter purpose

Provided Curther that, with effect from the 4th January

1992, and solely for the purpose referred to in the foregoing

proviso of this definition , where a Service Pension as aforesaid

in this definition has been-

(8) commuted in part only and the pensioner has

reached his nnd binhday, 50~ of the commuted pan

only of such Service Pension shall be taken into account,

Pension shall be taken illto account, so howeverthat with

effect from the 4th October, 1997, where stich Service

Pension has been commuted in whole, it shall no longer

be taken into account for the purposes of this Act;" "

3_ In section 33 of the principal Act,immediately after the words

in connection with his employment" there shall be added the words". =~13~"the

So however that, such abatement sbaU not exceed the amount that would

have been payable to the widow by the cmployer of her late husband,

had her husband died immediately after the date of the initial awlU'd of

his service pension".

(to the nearest whole cent) of the National Minimum Wage in the case o f a married
