AN ACT further IQ amend the Social &curiry Aa, Olp. 318.

BE IT ENACI EO by the President, by and with the advice and

consent of the House of Representat ives, in this present Parliamenl

assembled, and by the authority of the same, as follows:-

(I) This Act may be cited as the Sexial Se<:urity

(Amendment) Act , 1994. and shall be read and construed as one with

the Social Security Act , hereinafter refe rred 10 as ~the principal Act

This Act shall be dee med 10 have come into force as

(a) sections 2 to 6, paragraphs (b) and (c) of section 7,

sectio ns 8 10 22, 24 10 27, 30 to 34 and 36 to 39 sha ll be deemed to

have come into force on the lstJanuary. 1994

paragraph <a) of section 7 shall be deemed 10 have come

inlO force on Ihe 151 October. 1994;

(c) section 23 shall be deemed 10 have come into force on the

4th January. 1992;

(d) section 29 shall come into force on the enactment of this

Act ; and

(e) section 35 shall be: deemed 10 havecomc into force on the

2, The various sections and other Partsofthe principal Act shown

in the fiBt col umn of the Schedule to th is Act shall be amended by the

subsitution of the words shown in the second column the reof by the

words shown in the thi rd column of the said Schedule,

J. Subsection (I) of section 2 of the princi pal Act, shall be

amended as (01l0w5:-

(a) in the definition of "benefit", immediately after the

words " includes Bonus" there shall be inscned the words ",

Additional Bon us";

. (to) in the definition of " Di rector~, for the wo rds " the

Dlrect~r of Social S«urity" there shall be substi tu ted the wo rds

neurologist or psychi a trist provided tha t the person

concerned is not in possession of a dri ving licence ;H.

IS. Section 690fthe principal Act shall be amended as follow5:-

week" there shall be substituted the words " Lm9. 2S per week"; and

(b) in subsection (2) the reof, for the words " LmI 8.45 per

week" there shall be substituted the words " Lm 19.45 per week".

In paragraphs (a) and (b) of subsection ( I) of section 720fthe

principal Act. for tbe words "Lm6.30 per week" . wherever they occur,

there shall in each case be substitut ed the words " Lm7.30 per wee k", principal Att.

In paragraph (ili) of subsection (I) of section 73 of the AmeBd ..... n'

In section n of the principal Act, for the words " Lm3 per

In section 78 of the principal Act, for the words "lml per

week", and "40 cents pe r week" there shall be substituted the words

"Lm 1.25 per week" , a nd "65 cents per week", respectively.

Sectio n 8Softhe princi pal Ace shall be amended as follows:-

(a) for the marginal note therelo there shall be substituted

the following:-

"Bonus and Additional Bonus.";

(b) the current provisions thereof shall be re numbered as

subsection (I) thereor and immediately after subsection (I) thereof

as renumbered there shall be added the follo wing new subsection

(2), -

-(2) Save as pro vided for in section 96 of this Act and

subject 10 the o the r provisions of Ihis Act. a person who

becomes e ntitled to any pension, assis tance or allowance as is

referred to in subsection (I) of this sectio n, shall also be

e ntit led to receive an Additional Bonus every four weeks at

the rate of Lm l.34 per week o ver and above the Bonus to

which he is enti tl ed by virtue of subsection (I) of this section ;

Provided that notwithstanding any other provisions

of this Act. such person shall o nly be entitled to receive one

Additional Bonus at th e same time

Provided further that such Additional Bonus shall

only remain payable until such time as any such pension ,

assistance or allowa nce as is referred to in th e said subsection

(I) is payable .• , .

Section 860fthe principal Act sha ll be ame nded as follows: -

(a) in the marginal note thereto. immediately after the words

Mof Bonus- there shall be inse rted the words Mand Additional

Bonus-; and

(b) (i) immediately after the wo rds " to any person under"

there shall be inserted the words ~subsection ( 1) or; and

(ii) for the proviso thereto there shall be substituted the

following: -

" Proyided Ihat where any apportionment is requ ired

under section 87 of this Act, the amount of any Bonus

which the husband is entitl ed to receive fro m any

employer as aforesaid in this section and any weekly

allowance payable by any employer in te rms of the

Weekly Allowance National Sta ndard Order. 1988 shall

be abated from the Bonus a ndlor Additional Bon us due

to the husbaod under section 85 of this Act before the

apportionment of such Bonus andlor Additional Bonus is

ma d c . •• .

Section 88 of the princi pal Act shall be amended as follows : Ammdmen, 01

the Prime M i nister .~; and

(b) in subsection (2) thereor. for the words "The Director of

Welfare" there shall be substituted the words "The

aforem entioned Director General ".

In paragraph (b) of section 89 of the principal Act for th.: __ , 1 :o a t

In proviso (a) of section 90 of the principal Act , for the words

"or Bonus- there shall be substituted the words " , Bonus or Additional

Conditions of Employment (Regulation) Act, any Social

Assistance or pension payable unde r and in accordance with

. .... nIt<! in the foregoing provisions o f this Act (i ncluding an Orphans

Supple mentary Allowance but excluding -

(i) an Injury Pension assessed at 89% or less, an d

(ii) any National Minimum Pension Additional

Allowance) .

shall, as from the date of such awa rd orthe dalc as (rom which

such pension or assistance becomes due , whichever is the

latter date, automatically be incre ased by an amount

equivalent to two-thirds of such cost-of·living increase unless

a higher increase is du e under the afo resaid provisions of this

Act , in whi ch case, but save as provided fo r in the Sixth and

Twelfth Schedules to th is Act. the provisio ns of this section

shall not apply

Provided that , in the case of a Nationa l Min imum

Pe nsion as is payable under this Act to a married man who is

mainta ining his wife, the pro portion of two-th irds as

aforesaid in th is sectio n shall be upgraded to four-fifths

Provided further that, where a person is entitled la

two o r more pensions as aforesaid in thi s section at the same

time o r to a pension or pensions as aforesaid in this section

which is or a re beingsupplemented by Social A uistance, such

person shall only be e ntitled to only one such a uto ma tic

increase as aforesaid in tbis section in respect of the same
