AN ACT 10 amend Iht Sod"/ S,-mr;l), Aa /WJ7.
BE IT ENAcrED by the President. by and with the advice and
consent of the House of Rcpre$l:nlalatives. in Ihis present Parliamenl
aJsemhled . and by Ihe authority of same. as follows:-
I. ( I) Th is Act shall ~ cited as the Social Securi ty
(Amendment ) Act. 1991. and shall be read and construed as one with
the Social Sculrity Act. 1987. hereinafter referred to as -Ihe principal
Act-.
(2) The provisions of thi, Act shall ~ d«med 10 ha"e come
into force as follows
(a) section 2. sub·paragraph (ii) of paragraph (a) and
paragraph (b) of sect ion 6. S<.'Ctions 7. 8, 9 and 10. sub-paragraph
(ii) of paragraph (c). paragarnph ({'J. sub-paragraph (ii) of
paragraph (f) and par;lgraph (g) of section 11, section~ 12 to 17. 1!1
to 28. paragraph (b) of $I:<'lioo 29. $Cction 30. paragraph (a) of
section 31. sections 32 to 35. scclion 39. section 41. section 42
(e ~cluding the firsl provi so contained in ilem (d) of sub· paragraph
(ii) of paragraph (a) and IXlmgraphs (b) and (e)). sections 43 10 47
and seclions 49 and SOshall ~ deemed 10 have COme inlo force on

The A rrangement of Sections in tile principal Act shall be
amended as follo",s
(a) im mediately after the item "32. Non-eligib,lity 10 a
pension in respect of ",ido",hood"' there shall be inserted the
following new ilcm :-
"32A . Widow's Pension to be ab~led by pension from latc
husband's employer";
(b) lhe item s "34. Pension 10 widows ovcr the age of sl~ t y
years" . ""37. Wi dow's ijenefit". "45. Minimum rate of Survivor's
J' cnsion··. "46. Disqua li fication from Survivor's Pension"'. "SO.
Supplementary Pension and its abate men t"' and "63.
Disqualification from Two-Thirds Pcnsion" shall be deleted ;
(c) immediately after the item "52. WidQw in State·owned
ho!ipi tal or institution" there shall be insert ed the following new
itcm:-
"S2A. Wido",'er's Pension";
(d) fnr the item "79. Orpha n's Allowance" there shall be
substituted the item "79. Orph an 's Allowance and Orphan 's
Supplementary Allowancc";
(e) in the item "Sccond Schedule" the wwds "and Free
Medical Aids" against the sub-item MPA RT lI " shall bedele1ed and
immediately after Ihe said sub-i tem ~ PART 11" there shall be
added the following new $lJb-item :~
"PART IIA _ Free Medical Aids"
(f) in the item "Sixth Schedule" immediately before (he
words " Rate of Age Pension" against the sub-i tem '"PART 11 "

_ Cakulation of lhe Pensionable Income" there shall be inserted
the following new it em:-
" Fifleenth Schedule - Notional Rale of Age Pension" .
J . In subsect ion ( I) of !lection 13 of Ihe principal Act , for the

worker on projects in the areas of human welfare and
development and environ~n t aJ protection which are
remgnited as wch by the Minis!er in advance , for an y
period during which he is perfonning$I>Ch volunteer work
and has not yet reached pcMion age: 50h0weVC'r thal. for
this purpt".>Se. any sucb number of credi ted con!ributions
shall in no ~ e~ceed an aggregate of 260 in any period of

(b) in paragraph (b) of subsect ion (3) thereof, for the words

For the purposes of thissullsection, a person as aforesaid
shall , in establis hing his total "'cckly means , be considered as
forming a household on his own,"',
12, For SC1:tion 31 of the principal Act there shall be substituled
the following:-
"31. A widow whose hu sband sa lis" ", Ihe relevant

of personal injury caused by an Iccident arising Out of or in the
course of his employment or se lf-occupation, or tlccmed to be
so in aceordance with the provisions of seclion 28 of this Act,

section 28, shall be enlitled 10 a Widow's Pemion at the
peninent ratc shown in the l'o.'elfth Schedule to this Act, or 10
I Survivor's Pension; and where Ih is widow has the care and
cuslody of a child of her laIC husband . her rate of pension
under this scciton shall be increased in respect of each such
child by_
(a) !IS cents per week where an allowance under
paragraph (i), (ii) o r (iii) o f section 83 of this Act is
being paid in respect of such child: and
(b) 155 cents pe r week where an allowance unde r
paragraph (iv) of the said section 83 is being pa id in
respect of su.ch child
Provided that where , prior to the St h January, 1991,
a widow was entitl .. d to a Widow's Benefit payable ullder
this Act as in force prior to the date aforesaid 5hl.II, wi lh
effect from the 5th January 1991, be entitled to r~'Ceive a
pensic n bonus of Lm I per week in addition to her rale of
Widow's Pension Ihat is payable to her in accordance with
the provisions of th is SC1:tion. ".

26. Paragraph (i) of subsection (\) of section 56 of the principal

allowance or aSSislanee wilhin one week of a requesl by Ihe
Direclor for (he payment of such damages : and. for the purposcsof
this SubseClion. unless Ihe contrary is proved by lhe cntployer 10 the
,ati., faclion of the Direclor. (he amount so requeSled by the
DireClOr shall constitute a lawful claim on such employer."_

gross wage or gross income , as the CaSC may be, does

eslablished by a National Standard Order issued
under the Conditions of Employmelll (Regulation)
A{! during the period in respect of which such
assistance is due, such a member shall, for the
purpose of this paragraph, not be deemed to be an

(iii) in paragraph J thereof, immediately after the words
"Where any member" there shall be inserted the words "as

shall be deleted;

2. Where Ihe 10l al capilal resources referred to in ,ub·
paragraph (a)ofpa.-agraph I of this Part do oouceed the limit laid
(\owntherein, -
(a) Ihe first Lm250 of such capital resources shall be
ignored: and
(b) lhe value of any urban immovable property a:I' is
rc/erred to in lhe proviso to lhe aforesaid sub-.,..ragraph (a)
sllall be treated as producing an annual income equivalent 10
SS". of its capilal value.
3. Where any membcrof the household. olhe r Ihan Ihe head
of I>ousehold and his wife. ~ in posso;,s.-ion of any property as is
referred 10 in sub-.,..ragraph (a ) of paragraph I of this Part. -
(a ) the en tire value of any fUlUre house of rcsidc:rn:e or
part Ihereof belonging 10 such member in view of marriage
shall be ignored
(b) 0f\C'-1Ia1f of Ihe value of any other such property sh all
be disregarded unless such propert y had be<:n transferred or
donated to him by Ihe head of lhe household 0' his wife wi lhin
Ihe Iwelve months immediatc1y preceding Ihe claim for frce
Medica l Aids.
4. In cakulaling the income o r privilege which is or could be
received o r enjoyed be any member of the household. rw accounl
shall be laken of -
(a)
Ihe fir.>1 Lm40 arising out oflhe use of propert y
(b) any Social As.-istancc. Leprosy Assistance,
Tuberculosis A~ iS!ance, Milk Granl and Sickness Assistance
payable under Ihis Act and any pension or penskms (whelher
paid under Ihi$ Act or 001) up 10 a maximum aggregate
amounl equivalenl to the highest rate of a National Minimum
Pension according 10 claimant's marital sta tus 3$ is 5pC'cified in
Ihe Twel fth Schedule 10 this Act
(c) any family bonus payable under and in accordance
wilh section 9J A of Ihis Act. any Parenlal Allowance.
C hildren 's Allowance. Handicapped Child Allowance or
Maternily iJenefit payable under Ihis Act: and
(d) 7O.g% of the total net income. or o f any wage or
salary or of any privilege. bcllCfit or allowance or of any CJlcess
pension which is beingoToould be reeei"ed or enjoyed by any
member of Ihe hou$Chold. other Ihan the head of hou$ChoId or
his wife: and for Ihis purpose. Ihe total nel income. wage.
salary or pen sion shall be taken as the tOlal g'oss income.
wage. salary or pension leM any payment made by Ihe person
concerned by way of -
income lax under the Income Tax Ac~
(i)
(ii) contributions under Ihis Act
(iii) CKl""nses im:urr.:d for travening by publi,
