AN A CT 10 alntnd Ilrt Ptnsions Ordi/1<lnU (Cap. 93).

BE IT ENACfED by the President, by and "'ilh the advice and

consent of the Housc o f Representa tives, in this present Parliament

asse mbled. and by the autho rity of the same. as follows: -

(I) This Act may be cited as the Pe nskms(A me ndment) Act.

1990. and shall be read and conslrued as one with the Pensions

Ordinance:. hereinafter referred to as Wthe principal AeI W.

(a) TIM: provisions o f this Act ot her than those o f

section 6 thereof shall be: deemed 10 have come into fo rce: on the 12th

July. 1989.

(b) The proviSio ns of sect io n 6 of this ACI sh all be

deemed to have come into force on 1st J ~ nu ary, 1989.

In subparagraph (Hi) of paragrn ph (a) of subsection (I) of

section 7 of the principal law. for the words "or. if he has comp leted

twenty-five years service in the Po lice fo rce, on o r a ftc r allaining the age

of fifty years, or W there shall be substituted the words "or. if he has

completed twenty·five years' se rvice in the Po lice force, or",

For the words "of the laSI preceedi ng section" in section 8 of

the principal law , there sha ll be substi, uted the words "of subsection ( I)

of section 7 of this Ordinance:".

In paragraph (ii)of the proviso to sectio n 90ft he pri neipa l law.

the words". after he atfains the age of fifty years" sh all be deleted.

S. Immediately a fter subsect ion (2) of ~tion 11 o f the principa l A"",~'o/

law. the re shall be added the following subsection

"(3) The provisions of subsections ( I) and (21 of this

section shall not appl y to a pensioner who retired as a member

of th e Po lice force on grounds othe r than Ihose li sted in

paragr:lph (c) of subsect ion (I) of section 7 of ~his

shall be added the following pa ragraph

"(5) In Ih e ease of an officer to whom subparagraph

(c) of paragraph (I) of regulation 10 appl ies. the date of

retire",ent shall

(a ) where

such officer reachC5 the

age o f

rce ire men t; or

(b) where in the case o f ~u ch ~ n officer who had

been dismissed whe n a me mber of the Po lice force. such

officer would but for his dismissa l havecomplcted twe nty-

five years' service; or

(c)

where such offICer dies;

befo re his dismissal has been declared null by the competent

aut hority. be deemed to be the da y on which such officer

reaches the age of retirement. or in the case referred to in

subpa ragraph (b) hereof the day on wh ich he would have

completed twenty-five yea rs se rvice. or o n wh ich he dies,

whi cheve r is the earlier, and his pensio nable emohlments to be

ta l;.en in consideration shall be those wh ich he would ha~'e

been receiving on such date had he not been so di smissed. M

(d)

in regul3 tion 10

(i) for the words "of othe r IHIblie servIce. in

subparagraph (d ) o f paragra ph (I) thereof, the re shall be

substituted the wo rds Mo r othe r public service;M and

(ii)

immediatl"ly after subparagraph (d) of paragraph

(I) the reof. there shall be inserted the following paragraph

M(e) any period following dismissal from the

service, where such d ismi$sa.l is subsequen tly declared to

ha ve been invalid by a compe lent authority, up to

(i)

the time of reins tatement: or

(iil the date where such o fficer would have

completed .30 years' se rvice, Or in the case o f an

officer who was dismissed whe n a member of the

Police force tl" cnty- fi\'e years' se rvice; or

(iii) the date on which such office r wo uld have

to retirc because of age; or

the date when such office r dies;

(iv)

whichever is the eadicr."; and

(iii) immediately afte r paragraph (4) thereof. there shall

be inse rted the following paragraph

"(5) For the purpose of sub paragrap h (e) of

paragraph ( I ) of this reg ulat ion and of paragraph (5) of

rcgulmion 9, the te rm "dismissa l" shall he deemed to

incl ude "compu Lsory ret ire ment on th e ground of public

interest" a nd the ter m "dismissed" shall be construed

accordingly ."

(g)

regulation 20shall be amended as follows

(i) the words Kand of good moral character- in parag-

raph (\) thereof shall be deleted;

(ii) in paragraph (4) thereof, the words "while of a good

character" shall be deleted ; and

paragraph (l) of regulation 21 shall be deleted ....

(h)

The provisions of the princi pal law a5 amended by pa ragraphs

(d ) and (e ) of section 1 of Ihis Act, shall also apply to officers whose

dismissal or co mpulsory retireme nt from the scn;ce has been declared

invalid before the enactment of this Act. and wh ose re ti re ment date

computcd in accorda nce with the provisio ns of the principal law as

amc n<kd by the provisions of Ihis Act would fall on a date prior to the

datc of the e nact men t of Ihis Act.
