Article 1

The Government of Malta hereby agrees 10 the establishmem 011 the terrilOrics of

Mnh .. of a De1cgnt ion of the Commission .

2. The Communities shall have the capacity to conclude contracts. to acquire and

dispose of immovable and movable property as necessary for the effective fulfilment of

their duties and to conduct legal pTOCe<:!dings and shall be represented for that pur~

by the Commission. which shall. however. be obliged to fulfill the prOCt'dural and

administrative requi rements imposed by Maltese la .... in the execution of the aoove

facul ties.

Agree ment is contained in Ihe Schedule in this A ct .

the Government of Malta a nd the Commission o f the Europe an

Communities and that Agreemem, as coma ined in the Sched ule to this

Act . shall form part and be enforceable as pan of lhe la ... 'SofM alla. and

.... ithout prejudice 10 the gellCrality of Ihe foregoing. the Diplomatic

Immunit ies and Privi\c:gcs Act shall be construed and interpreted

(2) The Minister responsible for Foreign Affai~ shall by

notice in the: Gazette notify the da te on which lhe provisions o f the

said Agreement shall hal'e come into forte .

(3) Wit hout prejudice 10 subsection (I) of Ihis section the

provisions o f sections 8. 9. 10. I] and ]2 of the D ipkllTlatk Immunitic:s

and Privi\c:gcs Act shall apply 10 the immunities and pril;leges grame6

under th is Act as if such immunitic:s and privileges .... ere granted under

the said Diplomatic Immunilies and Privileges Act.

Those: righ ts and privileges and immunities shall be accorded on condi tion

that . in conform ity with tile provisions of article 17 o f Ihe I'TOlocol on th e privileges and

immunities of the European Communilies annexed 10 Ille Trealy cSlnbli~hing a single
