AN A CT 10 fJmend the Public LoIIO O,dinunct, Cup. 70.

BE IT ENACTED by Ihe President , by and wilh the adl"'cc and

consent of Ihe House of Representatives. in Ihis present Parliament

asse mbled. and by Ihe authority o f Ihe same. as follows:-

(I) This Act may be ci ted as the Public Lon o (Amendmell1) Shoo1 '~ k

This Act shall come in to force liS follows

and (ii) of paragraph

(3) Ihe provisions of subparagraphs

(a) of section 2, and of sections J and 5 thereof. shall come into

force on such dale as the Min iste r may by notice in the Gazette

appoi nt, and Ihe Minister may SO appoint different dates for

different areas of Malt a . indicating the areas and the 10110 offices

numbers in respect of which the dale or dales o f the coming imo

force o f the said sections shall app ly;

(b) all olher provisions shol1 come into force on the

publication of this Act in th e Gazette.

Section 5 of tile principal law sha ll be amended as follows

(a)

in subsection ( I) thereof-

( i) in paragraph (f). the worlb Mand when the

duplicate and triplicate copies must be deposi ted M shall be

deleted

(ii) for paragraph (h) there shall be substitllled the

following

"( h) all Olher matters concerning the manageme nt

orlbe public 10110, including any matters the Minister may

deem necessary or expedient \0 regulate in conseq ue nce

of th e oomputerization of the pu blic louo;"; and

<ili) immediately after paragraph (h) the re shall be

added the followin g new paragraph :-

"(i)

anythi ng that mayor iSlo be prescribed.";

(b) subsection (2) thereof shall be dele ted;

(c) the section shall be renumbered as a section without

(I) The compu tcrdiscsoontai ning the informa tion

concerning the stakes shall be delivered by the receivers

before the drawing in such place, in the presence of such

officials and under such measures of securi ty as may be

prescribed.

(2) If for any cause whatsoever the discs aforesaid

are not delivered as provitled in subsection (I) of thisscction ,

o r if the same are delivered in a defective 5tale, the sta kes

therein contained sha ll be eonsidered as void. and the person

staking shall be e ntitled to a refund of the amount staked

against the delive ry o f the t icket.~.

4. Section 9 of the principal law shall have effect subject to the

addition th ereto to the follo wing proviso

"Provided that if the lasl dayof aclaim pe riod falls o n a Sunday

or a public holiday. the period shall be extended until the first

following work ing day. ".

5. Section 10 of the principal law shall be amended as foHows

(.) for paragraph (bl thereof the re shall be substitul ed the

follo wing

-(b) if it does nOl taHy in all respects ..... ith the records

paragraph (cl thereof shall be deleted .

6. In sc:etion I1 o f the pri ncipa l law imme diately aft er su.bscction

(1 1) thereof. the re shall be added the followin g ne w subsect ion

"(12) In the eve nt that any prize in a pu blic Ionery or

tombol~

is rtOt awarded for any reason what$OCver. or remains

unclaimed for a period of one month after the date of the draw. the

value of such prize shall be paid to the Director of the Public LoIIO

within two month s from the date of the draw. and shall be credited

to an account styled "Unclai med Public Lottery and Tombola

Prizes FUlld ~; and any credit balance in the fund, o r pan thereof.

shall be distributed to philan tropie or charitable o rganizations or

mher deserving causes, or transferred to the Consolidated Fund. as

the Minister may from time to time direct .".

7. The following provisions of the principal law shall be amended

as hereinafter stat ed

(a)

in subsection (2) of section 12, ror the numbers "fifty"

and ~ two hundred" there shall be subst ituted the numbers "one

thousand" and "five thousand ", respectively; and for the words

"onc to six months" there shall be subst ituted the ... ·o rds ~si x to

twelve months"

(b) in subsection (3) of section 12. ror the numbers -five-

and "twenty" there shall be substituted the numbers "fifty" and

"two hundred" respectively;

(c) in subsection (2) of section 13, for th e numbers "twenty"

and "fiily". there shall be substiluted the numbe rs "one thousand "

and "five thousand - respeCli Yely; and for lhe words "onc 10 six

months- there shall be substituted the wo rds "six to twelve

months";

(d) in subsection (2) of sect ion 14. ror the numbers "five"

and "twenty" , there shall be substituted the numbers "fifty" and

"two hundred " re5pecti~cly;

(e) in subsect ion (3) of section 14, forthe numbers "two" and

-te n". there shall be substituted the numbers - fifty " and -two

hundred". respectivcly

(I) in subsect ion (2)ofseclion 15. ror the numbers "fifty" and

"two hund red" there shall be substituted the numbers "onc

thousand" and "five thousand" respeclivcly; and for the words

"one to six month s" there shall be substituted the words "six to

twe lve month s";

(g) in subsecl ion (3) of section 15. ror the words "five" and

-twen ty" there shall be substituted the words -fifty" and " t .... o

hundred" respectively;

(h) in section 21. for the numbers "six" and " twe nty~ there

shall be substi tuted the numbers "fifty- and "two hundred"

respectively.
