I. (1) This Act may be cited as the MembersofParl iament Pell-

sions ( Am endment) Act. 1989, and shall be rea d and construed as one

with th e Me mbers of Parliament Pensions Act . 1979, herei naft er refer-

red 10 as "the pri ncipal AcIM.

(2) The provisions of this Act, olher than this section and

paragraphs (a) and (b) of section 2 , shall come into force on such date as

the Ministe r may by notice in the Gazette appoint.

(3) Paragraphs (a) and (b) of seaion 2 of this Act shall be

deeme d to have come into force on 14 August, 1979.

Subsection ( I) of seaion 2 o f the principal Act shall be

ame nded as foll ows;-

(a) in the definition of Mpensionable emolumcnts-. im-

mediate ly after the words Mperiod of not less than five years in the

aggregat e." there shall be inserted the wo rds Mor for a period of less

than five years. being the whole period betwee n the first si lling o f

the House or o f the Legislative Assembly after any dissolution, up

to the date when the House or the Legislative Assembly, as the case

may be. is again dissolved aft er that silting (he reinafter referred to

as -the period of a Lcgislatu re-). has held any such office or any

two or mo re o r those offices,-, and for the words Md uring the five

years more favourable to the member. as the ease may be- there

shall be substi tuted the words -during lhe live years more favoura-

ble 10 Ihe membe r. o r du ring that period of a Legislature. as Ihe

case may be, being the mOSI fa vourable 10 Ihe member~;

(b) in the definition of "pensionabl e emoluments". im·

med ia tely after paragraph (b) Ihereof. Ihere shall be added the fol-

lowing proviso

" Provided that where a member who has not held any

such office o r Bny such o ffices for a whole period of a Legisla·

ture. bUI has held any such office for a period of less than five

years. o r has held a ny two or more of such offices for a pe riod

of less than five years in the aggregate. the ave rage of the sal-

ary payable in respect of such office and of Ihe honorarium

payable to a member , for a pe riod of five years in the aggre·

gate, or the average of the salaries payable in respect of the

sa id offices and of the honorarium payable to a member. for a

period o f five years in the aggrega te. shall be ca lcu lated in the

manner aforesaid during the five years more favuurable 10 the

mem ber un the dale uf his retiremenl;M; and

(c) for the definition o f "service pe nsion ~ there shall be sub-

st i. u.ed the fullowing new definition

Section 4 oflhc principal ACI sha ll be amended as follows

(a) in suhsc:ct ion (2) thereof. for the words Mlhe pe nsio n so

Ihe Nal ional 1nsura nce Act. 1956 a nd any service pe nsion" thcre

shall be substil ut ed the words "the pension so payable together

with any Olher ,;c" 'ice pension M: and

(b) for subsection (3) thereo f there shall be subs.itukd the

following ncw subsection

"(3) In any casc in which subseclion (2) o f this section

applies, Ih e prov isions of th e Social Securily Act. 1987. in so

far as they rcfer 10 pensions under that ACI, shall appl y .~.

In sectioll S of the prin cipal Act. for the words "Nationa l lnsur-

ance Ac •. 1956" wh ereve r they occu r Ihe re shall be substi tuted the

words "Social Sccuri ,y Act . 1987~.

Section 6/\ o f the prineip;al Act shall be amended as follows

(a) in 5uhsc:ction (4) 'hereofthe words Mby the amount ot any

pension payable 10 Ihe widow un<kr Ihe Nalional1nsura nC\' ACI.

1956. and " shall be deleted; and

(b) in subsection (5) th ereof, for the words "subsection (I) of

section 90 of the Nati onal Ins urance Act , 1956," there shall be sub-

sl;lI,lted the words "section 32 of the Social Securi ty Act, 1987 ....
