BE IT ENACT'ED by Ih e Preside nt. by and with Ihe advice a nd

:onsent of the House of Rep rese ntatives. in this present Parliament

lssembled. a nd by Ihe authority of Ihe sa me . as follows:~

I. ( I) Th is Act may be cited as the Local Manufactures

(Promolion) Act. 1989.

(2) This ACI shall be dee med 10 have come inlo force on the

28th July. 1989.

(Sections 5 and 6)

The items induded in the Third Column of this Schedule are arranged in the order

of the headings of the Nomenclatu re for the Classification of Goods in Customs Tariffs.

1955. under which they are classified. These headings are included in the Fir$t Column

of the Schedule_ The various Items are to be defined in acoordance with

(3) the rules for the interpretation of the Customs Co·operation Council

Nomenclature for the Classification of Goods: and

(b) the Explanatory Notes to the Cu,toms Co-operation Council Nomencla·

ture for the Class ifICation of Goods. 1955. published by the Customs Co-Operation

"'imported goods" has th e sa me meaning as is assigned 10 it in

the O rd inance. but does not include gOQds prod uced in these

Islands e~poned Iherefrom and afterwards imported thcrc into

"'levy" means th e levy payab le in accordance with the

provisions of this Act

UMaltese goods" means any goods which are wholly

assembled. produced, manufactured or processed in Malta; or

which have been subjected to part assembly. ptoduction.

monufact urc or processi ng in Maha; "part assembly. production,

manufacture or processing in Malta means the carrying OUI of

work in Malta on imported goods, the value of whkh work . bei ng

not less titan fifteen per centum of the value of the finished goods,

constitut es in the opinion of the Ministe r a reasonable proportion

of the value of the finished goods;

kMaha has the same meaning as is assigned to it in the

M

Constitution bu t does not include a Frecport as is defined in the

Malla Frcepom Act, 1989;

" Ministcr means the M inist~r responsible for industry;

MOrdinance means the Customs Ordinance

M

"'similar" means being in the opinion of the Minister similar in

funetion .

(I ) There shall be a hoard. to be known as the Local

Manufactures Promotion Board. to be composed as follows

(a)

a ehairman to be appointed by the Min iste r

(b) 1WO representatives of the Director. onc of whom shall

be a member of the: slaff of the Standards Laboratory of the

Depart ment of Industry

(c) a rcpr~ntative of the Director of Trade;

(d)

a represe ntative of the Comptroller of Customs

(e) a rcprescntative of the Commissioncr of Po lice

(0

a representative of the Direelor of Agriculture

(g) a reprcscnlativeofthe Malt a Development Corporation;

(h) a representative of an organisation 51: 1 up 10 promote

exports of Maltese goods.

(2) The Minililer shall appoint a public officc r not below the

rank of Assi stant Head. 10 be executive secretary of the Board .

(3) The members of the board shall be appointed by the

Ministe r afte r consulting the body or person whom such members shall

be represcntingon the Board.

(4) Th e Board may act notwithstanding any v3cnncy in its

composition and shall. subject to the provisions uftliis Act. regulate its

own procedure.

(I) Th e Boa rd shallllavt Iht following funct ions

(il 10 advise the Mi nister o n the policics 10 be followed

in tile imple mentation of this Act and in the exercise of any

powercxercisable by the MiniSlc ror conferred on tile Minister

in aceordancc with this Act;

(ii) to .«'Cive and consider appl icati ons in wri ti ng fro m

any person or organisation for the introduction . amendment

o r revoca tion of measures th at may be taken by the Mi nister

under thi s Act for tile promotio n of Maltese goods a nd 10

ma ke recom mendations thereon [0 the MinisTer

(iii) 10 ma ke recommendations 10 the Minister for the

introductio n. amendment or revocation of measures Ihal may

be lak en by the Minister under this Act . for the promotion of

Maltese goods eyen where no application has been made

\he reon in acrordance with paragraph <ii) hereof;

(iv) to keep socII reoords of such Mal tese goods. and of

the measures taken unde r this Act for their promotio n. as the

Minister may from time to time direct

(v) to ensu re complia nce wit h and to mon itor the

effect iveneu of. any measure Ihat may be laken by Ihe

Min ister under thi s Act. and to make recommendations

thereo n to the Mi nister.

(2) The BOlIrd shall . wi thin a period of two wee l s publish in

the Gazettc. a not ice. in broad terms . o f all appli ca tions received in

term s of parngraph (ii) of subsection (1) hereof. as we ll as any

suggestions made by the Board itself. to introduce. amend or revoke

me asures tha t may be take n under tllis Act for the promotion of Mal tese

goods. giving any person or o rganisation inte rested a pe riod of not less

than three wee ks to mah thei r wrin en subm issions on the

afore me nt ioned a pplica tio ns or suggest io ns.

(3) The Boa rd shall not later than three mont hs from the cnd

of the pe riod referred to in subsection (2) of thi s section. submi t 10 the

Minister its recommendat ions on the measures proposed to be taken .

amended or revo ked and on any written subm issions it may have

receivcd .

(4) Notwi thstandi ng the provisions o f subsection (3) of th is

ICCtkln the Minister may . by notice in the Gazell e. e~tend the period

du ring which the Board shall submit its recommendations.

considered as prohibited or restricted unless such Ie,'y is duly paid or

(I ) Any person guilty of an offence against Ihe provisions o f "'pplabot"~

'\Celion 18. or of any of paragraphs (a) III (I:. I o r pmagmph (mlof section pr .... ,"''''' al.' ,lit

112. of the Ordinan"" in relatiun 10 any goods subject to a levy in o.W"",,«

(2 ) The p!"o"isionsofSCCIion63 and n of the Ordinance shall

apply in rrlation 10 goods subject 10 a Ie,'y under this Act as if any

reference therein cont ~in-cd 10 the dut)' Iherein men lioned were also a

reference to the le"}' chargeable under this Ael.

(I) Any levy o n goods which arc nO! released by Ill<

Comptrolle r shalt not be refunded unless

(a) il is shown 10 the sa tisfaction of the Comptroller that such

goods had n", ocen I~nded in M:llta: or

( h) the re lease of the gOCKls is withheld throu gh no fault of

the importer.

whole or in part. of tile levy due on any goods imported by him. subj~t

month publish a list in Ihe Gazette of any e.\cmptions. in whole or in

part. which may he allowed in accordance with the provisionsofsub$ec-

tion ( I) of I his section .
