AN ACT 10 Ilm~nd Ih~ Import Duties A ct. /976 .

BE IT ENACTED by the President. by and with the advice and

consent of the House of Representatives, in this prese nt Parliamen t

assembled, and by the au th ority o f the same, as fo llow5:-

t. ( I) This Act may be cited as Ihe Import Duties

_ - . ........ n •. ( Amendment) (No. 3) Act , 1989. and shall be read and construed as

(2) Th is Act shall be deemed to have come inlo fo rce on

the 30th May , 1989.

Section]4 of the: principal Act shall be amended as follows

(a) subsect ion (2) thereof shall be renumbered as subsection

(4); and

(b) immediately after subs«lion ( \) thereof there shall be

inserted t ile follo .... ing subsections (2) and (3)

M(2) Where an application has bee n made to the

Ministe r to allow the importation into Malta of any goods

free of du ty, the importe r may make a deposit with the

Com pt roller of a sum of money sufficient in amount to cover

Ihe duties payable th ereon , or produ ce to the Comptroller

su,h banl:: guarantee by a local bank as the Comptroller deems

fit in lne ci r,umstam:c$, and thereupon the goods may be

released by the Comptroller to the importer in the same

manne r as if the dUly thereon had been paid.

(3) Any su m deposited in ~i rt ue of subsec.ion (2)

of this sect ion in respecI of any goods for which an applica tion

shall ha~e been made to the MiniSle r as aforesaid, shall be

passed to revenue in th e evem that the Ministe r refuses the

applica.ion aforesa id. and shall be re funded by the

Comptroller 10 the importer in the event that .he Minister

accedes to Ihe application ....

J. Heading 85. 15 in Chapter SS of the First Schedule to the

principal Act shall be amended as foll0W5

(a) for sub-heading (C) thereof and for Ill(; figures in respect

the reof in Ihe Second and Third Column there shall be substituted

respeclively the sub-heading shown in the Firsl Colum n and the

relative figures shown in the Second and Third Columns
