BE IT ENACfED by Ihe PresXirnt , by and ... ith the adviee and

I. (I) This Act may be riled as the Impon Duties (Amend·

ment) ( No. 2) Act. 1989, and shall beread and con5lrucd asoncwilh the

Impon Duties Act. 1976. hercinafter referred 10 115 ~the principal Act" ,

(2) The pfOyisions o f section 3 of Ihis Act shall have effect

from such date liS the Minister responsible for finance may by IlOlict: in

the Gazeue appoint.

In scaion 15 of lhe princi~1 Act . lhe: words "for use or con·

Part 11 or the Second Scbedule 10 the principal Act shall be

amended as follows: -

(a) for pangraph (m) Illere sha ll be substituted the follow ing

new parasraph

-(m) HOLlscllold and personal effects, fLlrnilLlre and other

domestic articlcs, (ucluding firea rms and weapons of all

kinds), which in the opinion of thc Complrollcr of Customs

have been in use within that household by the importing per-

son or his family, and arc imported by such person on remov-

ing his household from anothercoumry to Malt a provided Ihal

such articles arc imported with in six months from the date of

arrival in Malta of tile pe rson importing them to take up resi-

dence in Malta , o r within such other period which the Com-

ptroller of Customs may allow, ",

(b) for paragraph (0) there shall be substituted the following

ncw paragraph

-(0) One private motor,vehicle imported b~ a person

(husband and wifc coun ting as onc person for the purposes

hereof) who tr1Hlsfers his residence to Malta subject to such

person satisfying the Comptroller of Customs that he is in pos-

session of a permit of residence issued to him by the Govern-

ment in terms of sub-section I of Section 7 of lhe Imm igration

Act. 1970 and subject to the motor-vehicle being imported

wilhin six months of the date of the sa id permit or of such per-

son's arrival in Mnlta to take up residence, whiclKlve r date is

Provided thal. where an)' motor-vehicle imported as

aforesaid free of duty is so ld or disposed of by such person for

use in Malta, suc h mo tor-ve hicle shall be dee mcd to be ta ken

thereof in accordance with the provisions of scction 4 of this

(c) for paragraph Cp) the re shall be substitut ed the following

new paragraph

"(p) One private motor-~chide imported by a Maltese

migrant (husband a nd wife counting as one person for the pur-

poses hereof) who re turns to reside in Molta , subject to such

migrant satisfying the Comptroller of Customs that

(i) he has been residing away from Mal ta for an aggre-

gate of twenty years during the period of twen ty- five years im·

mediately preceding his arrival in Malta 10 take up residence

(ii) that he will be receiving in Malta from overseas a

yeady income of not less than five hundred Malt ese liri.
