BE IT ENACTED by tile President. by and with the advice and

consent of the House of Represe nt atives, in Ihis present Parliament

assembled. and by the authority o f the same. as follows:-

This Act may be cited as the Commissioners for Justice

( Amendment) Act. 1989. and shllll be read and construed as one with

the Commissioners for lustice Act. 1981. herdnaftCf referred to as "the

pri ncipal Act'".

Section 4 of the principal Act shall be ame nded lIS fo llows

(a) in subsection (I) thereof the words - who have completed

forty years of age shall be dele ted: and

(b) for subsection (3) the reof there shall be substituted the

followi ng

M(3) The Commissioners shall be re·el igible for appoint-

ment.··.

Section 8 of the principal Act shall be amended as follows

(a) in subsection (3 ) thereof for the words ··the Secretary

shall" the re shall be substituted the wo rds "the Regis trar of the

Courtss halr·;

(b) subsection (4) thereof shall be deleted , and

(c) for subsection (5) thereof there shall be substituted the

fo ll owing

"(5) The amount of th e penalty sha ll be due and owing

to the Government as a civil debt, liqu idated and cenDin. and

may be collected by the Regist rar of Courts. The order

referred to in sub$ection (2) of this !;CCIion shall eonstitute an

executive title within the mea nin g and for the purposes of Tit le

VII of Part I of Book Second of the Code of Organisation and

Civil Procedure.··.

Immediately after subsection (3) o f section 9 of the pri ncipal

Act, there shall be added the following sub!>ect ion

M(4) Whe re the Cou n confirms or varies the decision of the

Commissione r. the provisions of $ub5ectio ns (3), (5) and (6) of

section 8 shalJ apply: ' .

Section 42{ I )(b). " .

Notwithsta nding the provisions o f section 5 of this Act , the

provisions of the principal Act shall conti nue to apply to any offence

under sect ion 19 o f the Ed ucat ion Act, 1974 commi tted before the

com ing into force o f this Act.
