BE IT ENACfE O by tbe President . by and with the advice and

consent o f the House o f Representat ives, in Ihis present Parliament

asse mbled. and by the authority of the same, as follows:-

( I) Th is Act may be ci ted as the Engineerin g Profession Act. Sloon ~ ...

1988. (2) Thi s ACI shall come: into force on such dale as the

In thb Act , unless the con text othe rwise requires-

MEn¥ineer" means a person who has obtained a degree in

enginee nng from the University o f Malta Of from a foreign

institution recogn ised as eq uivalent ;

" Ministe r'" means the Minister responsible for infrast ruct ure

and . 10 the exte nt of any funCI ioru; delegated to it by the Minister.

" prescribed " mearu; prescri bed by regulations under this Act;

" profession of engineer" means the profession pf1lctised by an

e ngineer who is a warf1lnt holder;

" warrant" mean s a warrant granted under sect ion 4 of this Act;

and " wa rrant holde r~ shall be construed accordingly .

( L) No person sh.all practise the profession of engineer unless

he is t he holder of a warrant issued under section 4 of this Act.

A person shall not quali fy for a warran t unles$ -

he is a citizen of Mal ta;

(a)

he is of good cond uct;

(b)

(c)

he is of full legal capacity; and

(d)

shall satisfy the Board that

(i) he is in possession of such degree of the Unive rsity

o f Malta or an eq uivalent professional q ualifica tion relating 10

the engineering profession as at the re[cvar,! time is recognised

by the Board to be sufficient for the purposeS of this section ;

(ii) for the period of nOI less than onc year be fore or

after obtaining the qualificatio n referred to in sub-paragraph.

Ci) has undergone practical e ngineering train ing approved by

the Board; and

(iii) for a period of rIOt less than tWO years after

oblaining the quaL ification refe rred to in sul>- paragraph (i) has

trained in the practice of the profession under the supervision

of a practising e ngi neec

(3) (a) Notwithstanding the provisions of paragraph (d) of

subse!;lion (2) of this $«tion, a person woo on the first day of

January 1988 had already fora period of not less than fifteen years

before that da te. occupied a re~pon5ible engineering position, may

be exempted by the Board from having the requirements of

paragraph (d) of suhsection (2) of this section, and afte r passi ng a

prok ssional and academic assessment by the Board, may if he

sa tisfies paragra phs (a), (b) and (c) of that subsection , be granted a

wal11lnt.

(b) A request for the exe mption referred to in

paragraph (a) of this subsect ion must be mad e to the Board not

later than a year after the coming into force o f this section

Provided that a person who has obtained the warrant of

archited and ci vil engineer under the Architects Ordinance may

not at the SlIme time Qbtain the wal11lnt of Engineer.

4, (\) Th e warrant to practise the profession of e ngineer shaH

be issued by the Minister on the recommendation of the Boa rd to any

person who satisfies the requirement s of subsection (2), and. where

applicable, the provisions of subse!;lion (3), of section 3 of this A!;I .

(2) A warrant holde r may U$C th e designa tion " Inginier" o r

ill abbreviation ~ I n g." with his name .

S. (1) Notwitbstanding tbe provisions of subsection (2) of

section 3 oftbis Act. tb e Minister may , after consulting the BQard. grant

a s~iallicence to !lny person holding foreign professional engineering

qualificat ions acceptable to the Board. to exercise that profession in ,",or

Mal ta for a defi nite time and for a pillticular purpose and subject tosuch

otber eonditioll5 as may be specified in the licence.

(2) A person to whom a special licence is granted under tbe

pre<:eding SUbsection shall be deemed 10 be a warrant holder during the

time and for the purpose specified in the licence a nd tbe provisions of

Ihis Act and of any other law shall awly to him in the same manncr and

to the same extent like any other warrant holde r.

IHuJUjonijiet tal-Bord huma-

(I) The re sball be a Board, 10 be known as t be Engineering

Board, which shall consist of

(a) a chairman to be appointed by the Minister from among

persons who arc or have becn qualified to be appoimed judges in

Malta

(b) three members appointed by the Minister from among

warrant holders. one of wbom shall be a member of the academic

staff of the faculty of Engineering o f the University of Malta; and

(c) tbree members who shaH be elected by secret ballot by

warrant bolders from among themselves

Provided tbat IIOt more than two otthe elected membersshaU

be warrant holders practising in the same field of the profession

Provided further that all tile first members of the Board other

than the chairman shall be appoint ed by the Minister from among

persons who in his opinion qualify for the warrant .

(2) (a) The chairma n and the appointed members of the

BQard shall hold office for such term not exceeding three years and

under such conditions as may be set out in theiT lette r of

appointment.

(b) The elected members of the Board shall hold office

for a period of two years.

(c) T he first me mbers o f th e Board shal l hold office for a

period not exceeding one year .

(3) The members otthe Board shall , on the expiration of the

term of their office. be eligible to be reappointed or re-elected. as the

case maybe.

(4) When any vacancy in the BoardoccurslheMinilllershall,

as soon as practicable. in the case of an appointed member, appoint

allOtllerpel"SOfl to fill the vacancy, and in thecaseof an elected member.

cause an electioD to be held to fill the vacancy.

(S) The number of members necessary to form a q uorum

shall be three, but. SUbjCCllO lhe prese nce o f a quorum. the Board mily

act nOlwithstanding any vacaJlC)' among its members.

(6) T ile Minister may also designate a public officer 10 act as

secre tary 10 the Ik>ard, but such secretary sha ll not have a vote.

(7) Save as aforesaid the B03rd om)' make ils own rules and

othe rwise regulate its own procedure.

( I) The functions of the Board are -

(a) 10 oonsi l1er appl ications for the iMue of a warrant and

make ils recom mendations lhe reon \0 the Minister;

(b) \0 hold enquiries rega rdi ng any cha'l!c of professional

misconduct or abuse made against any enginee r in connection with

the u crcisc of his profession or wi th professional maUe rs, sav in g

the provisions of the Criminal Code or of a ny other law;

(c) IQ dca l wit h cases leading to the suspensio n or withdrawal

of a warran t, or of a special licence granted under section 5 of this

Act . as provided by or under thi s Act

(d ) to advise , or make recommenda tions or ot he rwise

express ils views 10, the Ministe r on any maller on which the

MiniSler is 10 consult with tile Board or on which the Board is to

ma ke recommendations to the Ministeror on which the opinio n or

recommendation of the Board is sought by the Minister;

(e) to perfQrm such othe r fun ct ions as ari se fro m this Act o r

any other law or as may be delegated \0 it by the Min ister under this

Act.

(2) In th e exercise of its functions under paragraphs (d) and

(e) of subsection (\) of this section the Board may consult with such

persons as it may decm appropriate, and in the exe rcise of its fUlKtions

under paragraphs (c), (d ) and (e) of subsection (\) of this section. may

a lso appoint commilleCli. of wh ich the chairman shall be a membe r of

the Boa rd , for the carryi ng out of such st udies or ot her work as the

Board may assign to them.

(3) The Board shall not later than three months after the cnd

o f each yea r, publ ish in the Gazelle a li st of persons who , on the 31st

December of the said year. were holders of a wurra nt issued under Ihis

Act. Such li st may. with the approva l of the Minister. be divided into

se parate parts. eac h part conta ining the list of warran t· holdersq ualified

in se parat e fields of engi neering .

in a partnership of enginee~,

(3) Any such partnersh ip shall, when duly formed accordi ng

(4) Every such partoersh ipshall give to the Ministeror tot he

Board such informal ion as they may reasonably requi re o r as may be

prescribed. a nd sllall give notice to tile Minister o r 10 Ille Board of any

relevant change in any informati on prev io usly give n to them, .... ithin

fifteen days after the date o n .... hich the change occurs.

(a) tile partners shall be joillll y a nd severall y re5poJl ~ibJe for

the act io ns and omissions of each and evcry o ne o f them in the

performance of their professional dUliC$. the mainlenance o f the

required professional standard and conduct and generally in the

fulfilmem o f their o bligations under this Act or any other

applicable law, and sllall al so be jointly and severally liable for any

loss o r damage resulti ng therefrom;

(b) a ny prohibi tion imposed by or undc r this Act in rC5pect

of o ne of tile partners sha ll apply to all the partners and to the

partnership evcn whe re the act prohibi ted or reslrict ed. o r gi vin g

rise 10 the prohibition or restriction, is done by one o f t he partners;

(c) any act or thing th at may be done by a warrant holder

may be done hy onc or more of the partners in the name of the

partnership: and any Dct or thing done in the name of the

partnership shall be do ne by one o r more o f the partners

(d ) the responsibil it ies and liabi li,ies for an ythi ng done or

omilled to be done du ri ng tile period in wh ich a person was a

partner in a partnership of e ngineers sha ll not cease , in respect of

such person, by his retirement , death or ot her cause by which he

ceases to be a partne r.

(I) Eve ry warrant holder or partnership registe red unde r l ..... oiIy

any negl igent act, error or omission oommilled by the warran t holder,

the partne rship. any partner thereof o r a n~ o r the employees. as well as

agai nst any claim in respect of any loss o r damage brought about or

cont ributed by a criminal or malicious act o r omissio n of any of the ir

e mployees

Provided that the provisions of this subsect ion Shall nOl apply

to warrant ho lders who are and for as long as Ihe~ are employed with the

Government in a civil o r mi litary ca pacity in respect of thei r official

duties,

(2) E very warrant holder or partnership of engineers bound

to be oovered by an indemnit y insurance under this section shall each

year within a week of laking out or renewing such indemnity insurance

infonn the Board in writing of the name oflhc insurance company and

the relative number of the insurance pol icy.

(I) Any agreement or arrangement purporting to exempt a

warrant holder or a partne rship of engineers from any liability,

responsibility or duty under Ihis Act or under any othe r law, or to

relieve them therefrom or, except under an imdemnity insurance as

provided under section 10 of thi s Act, 10 indemnify them against any

such liability. responsibility or duty shall be null a nd void.

(Z) An y agreement or othe r arrangement whereby a warrant

holder or a partnership of engi neers agrees to pay. directly or indirect ly.

to any person any com mission, brokerage fee. share of professional

fees, or any other form of reward or remuneration for obtaining or

having obtained any professional work shall be null and void.

IZ. (\ ) A conviction by any competent tribunal for any crime

liable 10 imprisonment for a term exceeding onc year, other than

involuntary homicide or any other crime against the person excusable in

tenns of the Criminal Code, shall be a cause of perpetual disability 10

obtain or retain the warrant.

(Z) Such disabi li ty shall be declared by the Minister by notice

published in the Gazette and shall be communicated 10 the person

disqualified, unless he has been interdicted by the sentence itself.

(3) The Minister may, at any time, and if the Board so

recommends , by order remove the di sabil ity dedared by him.

(1) A warrant, a special licence o r a registration of a

partne~hip of enginee~ issued, granted or made under the provisions

of this Act may be withdrawn or cancelled by the Minister at the request

of the warrant holder. licensee or partnership as the case may be.

(Z) Notwithstanding the foregoing, a fresh warrant, special

licence or regi stration of a partnership of engineers may be issued,

granted or made at any time if the conditions for such issue or

registration are satisfied.

The Minister may , by order in writing, suspend, revoke or

cancel a warrant , a special licence or registration of a partnership of

engine ers, if the warrant holder, lice nsee or anyone of the partners, as

the case may be -

(a) has been found guilty, after an inquiry by the Board, of

any of the following acts o r omissions -

(i) dishonesty, misconduct or gross negligence in the

exercise of his profession;

(i i) conduct discreditable to the profession;

(iii) fai lure 10 comply with regulations wit h respect 10

professional standa rds Of" practices;

(iv) fai lure IQ oomply with any condition anached to a

warran t issued unde r the provisions of section 16 of this Act ; or

(b) has been found guilty by a competent court of an o ffence

unde r the provisions of thi5 Act or of any regulations made

thereunder; o r

(c) wit hou t prej udice to the provisions of section 12 of this

Act. has been found guilty by a competent court of a crime affecting

public trust o r of thd l or of fraud or of knowingly r=:ivi ng

prope rty o btained by theft o r fraud .

IS. Whe re a warrant or specialliccnce issued under Ihis Act is Efl .... ....

The Minister may, afte r the expiration of one year from the Minist., .... y

date of the revoca tion or withdrawal of a warrant or special licence or .... frnh

the cance llation of a partnership of engineers, and if the Board so

recommends , issue a fresh warran t or spe<:iaJ lice nce or authorise the

registration of a partnership of e ngineers unde r the provisions of this

Act , subject to such conditions as he may deem necessary,

11, A warrant holder shall be remune rated for such specific

professional services as may be prescribed, solel y by such fees and under

such rules as may be prescribed.

Ig. ( \) The Ministe r may, after consulting the Board, recognise 0..

an association of warrant holders , to be known as the Chamber of

Professional Engineers.

(2) Whene ve r tbe number of members of that Chamber is

nOl less than two-thinb of the to tal numbe r of warrant -holders tqe

MiniSfer may recognise a code of ethics subm itt ed to him by that

Chamber and such code of ethics sball regul ate tbe professional

be haviou r of warran t holders which is not already prescri bed.

(3) 'The Ministe r may at a ny time amend any part of or

withdraw his recognition of such code of eth ics after giving due notice

thereof.

1'1. ( I) An y person who , for tbe purpose of obtain ing the 0fI<1I<a.

warrant. special licence or registration of a part nership of engineers

under the provisions of this Act, gives any wro ng in formation or

o therwise acts in a deceitful or fraudul ent manner shall be guilty of an

offence and shall on conviction be liable 10 a fi ne (mw/la) not exC«ding

o ne thousand liri (Lrn 1(00) or to imprisonment nOI exc:ccding twe lve

months o r to both such fine and imprisonment .

(2) Any person who, not being the holder of a warrant.

assumes or uses the designation Inginier" or its abbreviation " I ug. o r

en gineersha ll be guilty of an offence and shall on conviction be liable 10

a fine (mu/IQ) not exceeding one hund red 1in (Lm IOO) and in re~pecl of

a seoond or subseque nt o rreoc:e to imprisonment for a te rm nOI

exceeding three mont hs or to both such fi ne and imprisonment.

(3) Any pe rson who uses the designalion M[nginiera" in

re lation 10 a partnership o f engineers knowing Ihal such pannership is

not registered in accordance with the provisions of t his Act. or in any

m anner whatsoever knowingly makes use of I name falsely impl ying the

c)liSle nce of a partn ership of engineers registered as aforesaid shall be

guil tyof an offence and shall on conviction be liable toa fine (multo) not

exettding two hundred liri ( Lm200) and in respect of a second o r

subseque nt offence 10 imprisonment for a term not exceeding six

months or to both such fine and imprisonment .

(4) A ny person who. nol being lbe holder of a warrant o r a

special licence in accordance whh the provisio ns of th is Act, practises

the profession of engineer shall be guilty of an offence and shall on

co nvict ion be liable to a fine (mullo) of nol less than two hundred liri

(Lm200) but nOI exceeding four hundred liri ( Lm400), Hnd in respect o f

a second or sub$eq uent o ffence to a fine (multi') o f nOlless than th ree

hundred lin (LmJOO) bUI nol exceedi ng five hundred liri (LmSOO) or 10

im prisonment fo r a term not exceeding six mont hs or 10 both such fine

and imprisonment.

(5) Any person who oo ntrave ne$ the provisions of section 10

of this Act shall be guilty of an offence and s ltall on oonviction be liabl e

to a fi ne (mulla) of nOI less titan twO hundred !iri (Lm200) but not

exceeding five Itundred liri (LmSOO) and in Ihe case of a oootinuing

offence to an addi tiOflal fi ne (muf/.cl) of thirty liri (Lm30) for each day

duri ng which the offence continues.

(I) The provisions o f this Act establishing offellCCli and

punishments in respect thereof shall not affect the operation of any

other law establishing offences and punishments in respect of the same

acts or omissions and shall not . in particular, affect the application o f

any higher punislt mem unde r any other law.

(2) 'Ille provisions of the Probation of Offenders Act, 1957,

sltall not apply to tltis ACI.

(3) For lhe purposes of subsections (2) and (3) of section 19 0 f

For the purposcs of this Act -

(a) a person shall not bedeemed to practise the pro fession o!

c llgineer if he acts simpl y as an e mployee of or, assistant to. a

warrant holder or a partnershi p o f engi neers , and does not issue

any certifica tion o f an engineering na ture under his name ;

(b) to the extent that is so prescribed, a pe rson shall 001 be

dee med to exe rcise the profession 01 enginee r il he is in such

employment or ho lds or acts in such office, or pe rforms only such

wo rk , se rvices, acts or funClions as may be prescri bed.

The Minister may , afte r consulting the Board , make Il.,nlario_

regul at ions to give effect 10 any of the provisions of this Act and

generally 10 regulate th e profession of engineering, and , wit hout

prejudice to the generality of the foregoi ng, such regulations may in

particular incl ude provisions with respect 10 -

(a) the establishme nt of engineering standards, prOttduTes

and other dut ies and practices 10 be followed by warrant holders

eithe r generally or in particular fields of activity;

(b) the professiona l cond uct of warran t ho lders and the

standards of competency and integrity to be kept by the profess;or.

(c)

the issue o f guidelines and OIher advice 10 engineers;

(d) the work whiC h cannot b.: performed and services which

ca nnot be rendered, whether wholl y or in part, except by warrant

holders under tllis Act;

(e) the wo rk which cannot be performed and servke$ which

cannot be rendc red by warrant holders unde r this Act;

(f) the fees that may be ch arged by warran t holders or by 8

partnership of e ngineers for specifIC se rvices: the authority , if any,

by which any dispu te concerning sueh fees may be settled and the

procedu re to be followed by any such au thorit y

(g) the fees that ma y be charged for the issue of a warrant or

special licence o r for the regi strat ion of a part nership of engineers

or for copies the reof;

(h) the procedure to be followed by the Board in connect ion

wit h its functions unde r paragraphs (b) and (c) of subsection (I) of

section 7 oflhis Act; and the poowers which that Board shall have to

carry into effect Ihrn.e functions

(i) the pun ishments, penalties and o the r consequences and

effects 10 which a person may become liable or which may la ke

place in th e event of anyconlraven tion of, or non-compliance with.

the rrovi sio ns of an y regul ntion under this section; so howeve r that

no punish ment so imposed shall exceed a fine (multa ) of onc

Ihousand liri (Lm lOOO) or imprisonment for a tenn of one yea r, or

of both such fine and imprisonmenl, o r in the case of a con tinuing

o ffence, a fine (mu/rll) of len liri (LmtO) for each day during which

the offence continues. whethe r or not

(j) the forms o f rcpons o r in fonnation whkh a warrant

holde r or a part nership of engineers may be required to furnish to

the Minister or to tile Board ;

(k) any maller which is required or is authorised by Ihis Act

to be prescribed.

This Act shall appl y only 10 the Engi nee ring profession in the

fie lds o f Mechanica l Engineeri ng and Elect rical Engineering

Provided that the Min ister may from time 10 time by OTder

exte nd the applicability of this Act 10 other fields of the Engineering

Profession .
