AN ACT/unherloamelld Ihe Na/iol111/ Tourism OrganiSlllicn ACI, /984.

BE IT ENACTED by the Presiden t. by and with the consent of

the House of Represe nt atives. in this present Parli ame nt assemb led.

and by the alllhority of the same, as follows :-

I. This Act may be cited as tile National To urism Organisa tio n

(Ame ndment ) Act. 1988. and shall be read and construed as o ne with

the National "tourism O rganisation Ac!. 1984. hereinafte r referred to as

~ the principal Act -.

Section 2 of the principal Act shall be arrn:nded as folloW5

(a) the definition ~ Action Council for To urism- shall be

substituted by the following

-" As.sociation- means an association recognised by the

Ministe r as Ih e association re presenting the largest number

of entrepreneurs in a particular sector of the Tourism

Industry; provided that when more than one Association

claims re prese nt utio n of any particular sector of the tourism

industry, the Min ister shall be bound to recognise that

AS!oOCiat ion, wh ich, upon due verification of the mOSt Up-IO-

date records of association membership kept by the Registrar

of Trade Unions for the purposes of the Industrial Rela tio ns

Act , 1976. TCli ul lS as representing the largest number of

entre prene urs, who are members of an associa tio n, in that

sector;-; and

(b) immediately afte r the defin ition of - Pe rson" there shall

be added the fo llowing definit ions

"-Secretary - means the secretary of the Organisa tion

appointed by the Minister unde r section 9 of this Act;

'"Treas urer"' means the treasurer of the Organisation

appointed under section 9 of thi s Act : '.

Section 20 of the principal Act shall be amended as follows: Am<odm<ntof

(b) immediately afte r subsection (1) thereof as renumbered,

there shall be added the following subsections

"(2) Th e financial year of the organisa tion shall

com mence on the 1st January of each year and end on the

31st December of each year.

(3) As soon as may be after the end of each

financial year, and in no case later than ~i1l mOll1bs after the

end of each financial year, the Treasurer shall deliver the

audited acrounts of the Organisation to the Minister who

shall as soon as may be lay the same on Ihe Table of the

House of Representatives, ~.

The provisions of section 6 of this Act shall be deemed to

have come into force on the 1st August , 1986, and notwithstanding

the provisions of the National Tourism Organisation (Ame ndment)

Act XXVI[ of 1986. Act, 1986, the National T ourism Orga nisatio n (Contribution)

Regulations, 1984, Shall be deemed to have remained in (oTee on and

afler the 1st day of August. 1986. and to have been made in virtue of

the powers of section 16 of the principal Act as amended by section 6

of this Act.
