AN ACT IQ IJmend the Emblem of MaltlJ A ct, 1975.

BE IT ENA CTE D by the Presidem, by and with the advice and

consent of the House of Representa tives, in this present Parliament

assembled. ~nd by the authority of the same. as foJlows:-

This Aet may be ci ted as the Emblem of Malta (Amend me nt)

Act, 1988. and shall be read and construed as one with the Emble m of

Malta Act. 1975. hereinafter referred to as "the principal Act" .

In sect ion I of the principal Act , for tile words "Emblem of

Malta Act, 1975"". there silall be substituted the words " Emblcm and

Public Seal of Malta Acl. 1975".

J. For section 2 of the principal Act there shall be substituted the

following

2. (I) The Emblem of Malta shall consist of a shield

showing an heraldic represen tation of the National flag of

Malta: above the sh iel d a mura l crown in gold with asalJy port

and eight turrets (five only being visible) representing the

fortifications of Ma lta and denoti ng a City State ; and around

the shield a wreath of two branches the dexter of Olive. the

sin ister a Palm. symbols of peace a nd traditionally associated

wi th Malta, all in their prope r colours. tied at base with a

whi te ribbon , b~cked red and upon which are written the

words REP UBBLlKA TA' MALTA in capital letters in

black: as shown depicted in th e FIRST SCHED ULE 10 th is

Act.

(2) The Emh lem of Malta shall replace Ihe

Emble m of Malta adopted by Ihis Act on the 11th July, 1975.

as well as the armorial ensigns assigned for Malt a hy warrant

dated 2nd September, 1964 a lld published in the Gazette by

Government Notice No. 550 on 12th October. 1964.".

For sectio n 3 of the principal Actlhere sha ll be substituted the

following

3. (I) It shall not be lawful for any person to use for

any purpose whatsoeve r, without the written authority o f the

Prime Minister. or not in accordance with any condition con·

tained in any such wriUen authority. the Emblem of Malta or

any imitation thereof, or the armorial ensigns o r the emblem

ref.err~d 10 in subsection (2) of section 2 of this Act or any

Imllal10n thereof.

(2) It shall nOI be lawful for any person to

incorporate with in any design, for any purpose whatsoever.

without the wriuen authority of the Prime Minister. or nOI in

accordance with any conditio n contained in any such written

authority. the National Flag of Malta. ".

For section 4 of the pri ncipal Act there shall be substitu ted the

following sections

4. The Public Seal of Malta shall be a seal of a design as

show n in the Second Sehedule to this Act.

5. (I ) Thc President of Malta may designate a

Minister or a senior officer in the service of Malta to be the

Custodian of the Public Seal and may give di rections as to the

manne r in which it shall be kept and used.

(2) In defau lt of any such designat ion. the

Presiden t of Ma lta shall be the Custodian of the Public Seal.

It shall not be lawful for any person to publicly vilify

by words. gestures, written maller. whether printed or not,or

pictures or by some other visible means, or in any ma nner to,

deface, the National Flag of Malta or the Emb lem of Malta.

(I) A ny person who contravenes the provisions of

sections 3 and 6 of this Aet shall be guilty of an offence and

shall be liable on conviction 10 a fine (m u/la) of nOI less than

fifty liri and not more than one thousand liri and in the ease of

a continuing offence to an addit ional fine (mU/la) of not less

than one lira for each day during which the offence cont inues.

(2) No proceed ings for an offence under this Act

shall be lnsututed except with the consent of the Attorney

General." .
