AN ACT la tJUlble Ministers 10 delegate /unctioM of tlui, offICe /0

P(Jr/iamemary Suretaries.

BE IT ENACTED by the President, by and with the advice and

consent of the House of Representatives, in this prese nt Parliament

assembled, and by the authority of the same, as follows:-

I. This Act may be Cited as the Ministers (Delegation of Sho" title.

Funct ions) Act, 1988.

In this Act, unless the context otherwise requires -

"functions" indudes POWCI'll and duties;

"law~ means an Act o f Parliament or other ACI passed by the

Legislature of Malta o r an Ordinance ;

"Minister~ means the bolder of an office under section 80 of

the Constitution.

(I) A Minister may delegate 10 a Parliamentary Se<:retary

assisting him in the perfonnance of his duties, any functions which in

virtue of his office are conferred on him by or unde r any law.

(2) A delegation o f functions under this seetion shall be

without prejudice to the exercise of t hose functiOn!; by the Minister.

(3) The power so delegated to make orders, rules or

regulations shall, unless the cont rary intention appears , beconstrued as

including a power to revoke, amend or vary o rders, rules or regulations.

amendment, variation, substitution or rescission of. such delegation

shall be made in writing under the ha nd of ttie Minister, a nd no tice
