AN ACT fur/her IQ amend Ihe Na/ional Insurance Act. 1956.

BE IT ENACTE D by the President, by and with the advice and

consent of the House of Representatives. in this present Parliament

assembled. and by the authority of the same, as follows:-

I. (1) This Act may be cited as the National In surance (Amend- SIlo," Iil l •

ment) Act. 1987. and shall be read and construed as onc with the • 00

National Insurance Act. 1956. hereinafter referred to as " the principal oomm'''''''''''''nl

Act'· .

(2)

This Aet shall be deemed to have come into force, as

follows

(i) sections 6 to 13. 15 and 16 with effect from 3rd

January, 1987; and

(ii)

sections 2 to 5 and 14 with effect from 51h January.

1987.

In subsection (1) of section 2 of the principal Act , immedia tely Amend"",nl

be fore the definition of "beneficiary'" there shall be inserted the follow· uf

ing new definition

.. "basic lOo'eekly wage" and "basic salary" mean the gross wage

or salar~ thal IS payable 10 an employed person by or on behalf

of his employer excluding any remuneration for overtime. any

form of bonus. a ny e ~tra allowances. any remuneration in kind

and co mmissions;'".

Section 5Doflhe principal Act shall be amended as tollows

Scction 9 of the princi pal Act shall be amended as (011(1\\'5

(a) for subsect ion (2) thereof the re shall be subst iu.n ed the

followi ng -

M(2) (a)

Contributions shall be credited-

(i) to a widow , whet her she is a n insu red pcrson

or not, a nd, whc thc r she is entitled to a widow 's pension

or not, for any pc riod during which she has the care of

a child of he r IlIte husband 's and du ring which she doe s

not rc-marr~: and

(ii) with effect from thc 5th Januar~, 1987, \0 an

ex-member of the Malta PoIire Foro: or of the Armed Forces

of Mal ta who retires or has retired from th e service o n

a full pe nsion fro m Government as hise mplo~eron com-

pletio n of service prio r to reaching pension age, for any

period during which he is not gainfully occupied and has

not )~ t reached pension age: and

(b) A contribution shall be credited \0 a n ~ insu red

p<= " -

(i) for any contribution week fo r each da~ of

which he is entitled to sickness benefit , or inj ur~ be nefit,

or un e mplo~ment be nefit, or special unemplo~ment be-

nefit , or increased invalidity pension, or disablement pen-

sion where the degre e of di sablemcnt is assessed at one

hundred per ce nt, or, prior to reaching pension agc, a

nat ional min imum pension ;

(ii) if he is norm ally employed in insu rable em-

ployment and normall y relies on such e mployme nt fo r

his livelihood, for any cont ribut ion wee k eaeh day o f

which is fo r him a da~ o f incapaci ty for .... o rk o r a da~

o f unemployme nt;

(iii) for any conu ibution week for each da~ of

wh ich he is entitled, o r wo uld but tor the prOVIsions of

sub-paragraph (i) o f paragraph (a) of the proviso to sub-

section ( 1) of section 16A o f this Act have bee n ent itled ,

to an inval id ity pensi on

Provided that undcr th is subsection no more tha n onc

~"ntribution shall be credited tu an insured person [or any

on e week, and no contribution shall becreditcd for a ny wee k

for which a class onc or class two contributiun is p~yabl e by

ur in respect of him under this Act."

(b) in sub'paragrap h (i) of paragraph (a) of subsection (3)

thereof, immediately after the words "is a widow to whom" there

sha ll be inserted the words "sub'paragraph (i) of paragraph (a) or' ,

S. Subsection (3) of section \0 of the principal ACI shall be Amc:ndmen,

amended as follows

(a) in paragraph (a) thcreof, immedialely before the words I'fiocip.'

(b) of subsection (3) of section 9 o f th is Act in virtue of sub-parag-

raph (ii) of paragraph (a) o f subsection (2) of the said section 9

shall not be taken into account in connection with any claim for

sickness benefit, unemployment benefit and special unemploy -

ment benefit, and": and

(b) in paragrap h (b) thereof, immediately after thc words

"subsection (4) of section 9" there shall be inserted the words",

class one cont ributions credited in accordance wi th paragraph (b)

of subsection (3) of section 9 of this Act in virtue of sub-paragraph

(ii) of paragraph (a) of subsection (2) of the s.a id section 9",

"(3) Subject to the provisions of th is Act, whe re an insured principal

person is entitled to a service pension

(a) with effect from the 2nd January , 19l18, if his service

pension and the rate of Retirement Pension applicable in his

case together e"eeed two-third~ of his pensionable income, such

person shall be entitled to a Retirement Pension, sohowevcr

that, where the rate of such Retircment Pension and his service

pension togcther e"cced the current basic wee kly wage or ba~ic

salary of the post on wh ich his service pension was awarded,

such person shall be entitlc{i 10 receive by way of a Retirement

Pension such part as shall cnsure Ihat his service pension and

his Retirement Pension together do nut e~~.",ed th", aforesaid

current basic weekly wage or basic salary of the post on which

his service pension was awarded

Provided lhat, with effect from 3rd January , 1987 -

(i) a pcrwn who is alrcady entit led to a Retire,

ment Pension on 2nd January, 1987, as payable under

the provisions of the National Insurance Act 1956 as;n

force on such date, shall, in addition to the rate of Rctire-

ment Pcnsion as is payable 10 him on the date aforesaid,

be entitled to onc-half of the difference between such

rate of Ret irement Pension as is applicable in his case in

terms of thi5 Act in accordance with thc Fifth Schedule

(0 this Act and (he rale of Retirement Pension as is

pa yable to him on th e date aforesaid; and

(ii) a pcrwn who is entit led 10 " Retirement Pen -

sion for the first time on any day between the 3rd January,

1987 and 1st January. 1988, shall . in additio[l to the rate

of Retirement Pension as would have been payable 10

him under the provisions of the Natio nal Insurance Act

1956 as in force on 2nd January. 1987. be ent itled to

one-half of Ihe difference between such rale of Reti re-

ment Pensi on as is applicable in his case ill terms of this

Act in accordance with the Fifth Schedule to this Act

and the rate o f Retirement Pension as would otherwise

have been payable to him under tbe aforesaid provisions

of the National Insurance Act 1956: or

(b) if his service pension and the rate of Retirement

Pension applicable in his case in terms of the foregoing pro-

visions of this subsection together do not exceed two-thirds

of his po;:nsionablc income. such a person shall be entitled to

an Increased Retirement Pelision or such p!lrt thereof as shall

ensure that the afore -mentioned two-thirds of his pensionable

income are not exceeded.

For thc purposes of this section, thc "current basic wcekly

wage or basic salary" shall be takcn to be that current on the first

Sa turday of the year in respect of which any payment under this section

Section 91 of the principal Act shall be amended as follows

(a) immediately 31 the end of subseetion ( I) thereof there

shall be inserted the following proviso

"Provided that in the case of a self-employed perS(Hl wilo

ilas paid less than 156 comributions after the 21st day of

January , 1979. where the Director is satisfied that sucil lack

of comributions was due to circumstances beyond the comrol

of the self·employed person concerned. the said proportion

of two-tilirds silall be substi tuted by such other proportion as

the numbcrof contributions paid after the 21st day of January.

1979. bears to 234; otilerwise. such self-employed person silall

not be emitled to a Two-Thirds Pension under this Part

but shall instead be entitled to a pension as is payable under

and in accordance with the provisions of Part III of this Act. ";

(b) in subsection (2) thereof. for the words "The full rate

of pension" there shall be substituted the words "Such rate of

pension as is referred to in subsection (I) of this section"

(c) immediately 3t the end of subsection (3) thereof there

shall be inserted the following proviso

"Provided that in the cases referred 10 under sub-parag-

raph (i) of paragraph (a) and under paragraph (c) of thIS

subsection the provisions of the proviso 10 subsection (I) of

this section shall nonetheless apply."; and

(d) in subsection (4) thereof, immediately after the word~

"referred to in subsections ( I ) and (3) of this section" ~nd the

words "shall substi tute the said proportion of two-thirds" there

shall be lflserted lfl each case the words "OJ any other proportion

substituted therefor in accorda nce with the proviso 10 subsection

(I) of this section".
