AN ACT w amend tht Sociili S«ur;ly ACI. /987.

BE IT ENACfED hythe Presiden t. by and with the ad,' ice and consent of

th e House of Representati~n, in Ihispresent Parliamemassembled, and by lhe

authority of the ... me, as follow~'_

I. (I) Th il; Act may be cited as the Social Security (Amendment) Act.

1987 and shaU be read and con~trued as one with the Social Securi ty Act .

1987, hereinafter re fe rred la as "the principal Act

(2) This Act. other than this section , shall be deemed to have come

into force as follows

(a) ""ctions 3 to 5. paragraph (b) of ""clion 6. sect ions 7 to 9. 12. \3

and from 15 to 17 with effect from the 1st January. 19!n; and

(b) section 2. paragraph (a) of section 6. sections \0. 11 and 14 wit h

Paragraph (a) of subsection (3, 01 sectio n 16 of the principal Act """,n<lrn<n' of

Subsection (4) of section 27 of the prindp;,l Act shall be amended ;,s

follows

(b) immediate ly after the words ·· Part [If of the Si"h Schedule to

this Ac!"· there 'hall be added the words ··so however Ihat a person who has

become an inmate of a "ate·owned hospital for the purpose of ohtaining

medical or surgical treatment or an inmale of a hO'lpilal fo. mental diseases

for the purpose of obtaining mental treatment. shall not be treated a~ ,uch

an inmate so long as he continues 10 require such treatment during the fi"'t

two months as from th e date of his admission to the hospit ar·.

Section 29 of Ihe principal Act shall be amended as follows

(a) in subsection (3) Ihereof. for the words U99%'", wherever they

occur. there shall be subslitute<lt he words "89%~; and

(b) in subsection (4) thereof, for the words uassessed at lOO%~

there shall ~ substituted the words ~as~ssed al 90% Or more~.

Section 39 of th e principal Act shall be amended as follows

<a) in Ihe proviso thereto for the words ··Provided Iha!"" there shall

~ substituted the words ·· Provided further thar·; and

(b) immedialely after the words '" Pari V of Ihis Act: ~ Ihere shall

~ adde<lthe following new proviso

" Provided tho\ with effect from .he 1st January. 1987. where

the deceased pensioner had been. prior to reaching pension age,

entitled to a pension under sc<:tion 26 of Ihis Act. and al any time

thereafter cca~d to ~ enlitled 10 such pension as a result of his

t>ecoming gainfully occupie<l. any contrihutions crediled under ~e·

lion 16 of thi~ Act while Ihe deeca5ed pensioner was entilled to such

pension shall. for the purpose of assessing her righ t 10 a Survivor·,

Pension. be taken into account: SO however that any such number

of crediled contributions as is taken in to accounl 'hall not exceed

the number of conlributions paid bylhedcreased pensioner between

the date of his cessation of entillement to such pension and Ihe date

of his relirement:~.

Section 56 of Ihe principal Act shall be amended as follows

(a) in paragraph (i) of subsection ( I) Ihcreof -

(iJ for the words ··lhe firsl Saturday of January 1988·· there

shall be substituted the ,,·ords ··the fim Saturday of January 1987"·;

and

(ii) lhe proviso to the said paragraph (i) shall be deleted; and

(b) for the marginal note lhereto there shall be sUbslituted the

following: ··Entitlementto Retirement Pension and 1 ncrease.' Retirement

Pension u .

Immediately after su!.>sect ion (3) of sectio n 82 of the principal Am<oo"","' .,.-

Act. there shall be added the following proviso,

" I'rovided that, with effect from the 41h July 1987. the provisio ns o f ~"" ipaJ Act.

this subse.:tion shall ce",", to apply in respect of any pregnancy by virtue ot·

which the claimant enters her eighlh nlOnth of pregnancy al any lime aher

the said date.".

Section 83 of the principal Act shall be amended as follows,

(a) for the words from "the head of a hou ... hold" up to the words pt;ncipaJ Act

of every child in any household to have an allowance paid ou t in his

respect under, and in accordance with , the provisions of this section at

one o f the following rates, as long as such child is the son or daughter

of the head o f household

in the household ;

(ii) Lm2.70 per wee k whe re such child is Ihe serond eligible

child in the household ;

(iii) Lml.70 per week where such child is Ihe third eligible

child in the household;

eligible child in the household:"; and

(b)

in Ihe proviso thereto -

tuted the words "every child" ;
