ACT No. XVI of 1987

AN ACT lw/her la amend IlIe Enema/la A CI. 1977.

BE IT ENACTED by the President. by and wilh the advice and

consent of the House of Representatives. in this present Parliament

assembled. and by lhe authority of the same. as fol1ows: -

This Act may be cited as the Enemalta (Amendment) Act.

1987 and shall be read and construed as one with lhe Enemalta Act.

1977. heroinafter referred to as "the principal Act".

For subsr:(:tion (2) of section 5 of the principal Act there shall

be ~ubstituted the following subsection

"(2) The Board shall consist of not less than three and Dot

more than nine membcrs appointed by the Minister except for

one member who shall be ele<:ted by secret ballot by and from

amongst the employees of the Corporation who are eligible to

vote in and stand for such ele<:tions in accordance with regula tioos

made under section SA of this Act. The Minister shall designate

one of the appointed members as Chairman and another such

member as Deputy Chairman and such other member shaH have

all the powers and perform all the func tions of the OIairman

during his absence or until a new Cha innan has been appointed

following resignation. termination of appointment or death of

the Chairman.".

Immediately after section 5 of the principal Act there shall

be added the following new section

"-

SA. The Minister may make regulations for giving

employees of the: Corporation and in particular. but witilcut

prejudice to tile generality of the provision of the foregoing.

shall vacate his office;

(e) delermine the manner and time for filling a

vacancy;

doxm necessary or expcdienl.".

In section 6 of the princir-al Act , for the words "the members

S. In se.:tion 7 of the principal Act. immediatcly after the words

"'for a pp.,intmenj"' IIlere shall be inserted the words "or clection".
