This Act may be cited as the Hotels and

Establishments (Amendment) Act. 1986, and shall be read and OOll8trucd

as one with the Hotels and Catering Establishments Act. 1967, here.

inafter referred to as "the principal Act",

(2) This Act shall come into force on such date Il!I the

Minister responsible for tourism may by notice in the Gazette appoint.

(a) in the definition of "guest" immedia tely after the words "at

(b) immediately after the definitiml "licence" there shall be

""hQStcl" means any bu ilding hCl"t'cvcr described, but

not a holel, guest house or lodging house, in which acrornmo-

dation is provided to a gUe!it against payment, and in which

the facilities offcred are less than those usually expected in

ootels Qf guest 00uscs

"hostel keeper" means anY person to whom a licence to

keep or manage a hQStel has been issued in accordance with

the provisions of se<:tion 4 of this ACI and includes any person

to woom a licence has been lawfully trans.ferred in accordance

with the provisions of section 6 of this Ac!:",

Section 4 of the principal Act shall be amended as follows

(a) in subsections (I), (3) and (4) thereof for the words "hotel tb~ princip.t

or catering establishment" wherever they oocur. there shall be A~

substituted in each case the words "botel, hostel or catering estab-

lishment"; and

(b) immediately after subsection (I) thereof there &hall be

inserted the following new subsection

"(lA) A licence 10 keep a hostel may be gr311ted by the

Board to any person in respect of any bu ilding where the

standard of comfort and accommodation provided for the

guests is lower than that nonoaHy provided for guests in

hotels or guest hOUSl:s and where -

iil the facilities provided are mainly intended for

youths. students or other special category of persons

travelling on a low budget, and

(ii) the accorrunodation provIded may be m dor-

mitones or m slmtlar mulh-bedded rooms. '

catering establishment" wherever they occur there shaH be substituted ...:tloll' ot

S. In section 6 of the principal Act for the words "a hotel or a Am<1><lm<n< of

catering establ i,hment" in ~; ubsection (I) thereof and "hotel or catering OK';"" 6 of

establishment" in subsectio n (2) thereof, there shall be substituted \he principal

respectively the words "a hotel. a hostel or a catering establishment" Act.

Se<:tion 7 of lhe principal Act shall be amended as follows

la) in subsection (1) thereof for the wonts "a hotel or catering ,b. principal

establishment" and "the hotel-keeper or the catering establishment A.

keeper" there shall be substituted respoxtively the words "a hotel.

hostel or catering establ ishment" and " the hotel-keeper. the hostel

keeper or the catering establishment keeper";

(b) in subseclion 0 ) thereof for the words "hotel-keeper or

catering establishment" and "the hotel or catering establishment"

there shall be substituted respe.::tively the words "hotel-keeper or

hostel keeper or catering establishment keeper" and "the hotel,

hostel or catering establishment"; and

(c) in subsection (5) thereof for the words "the hotel.keeper"

there shall be substituted the words "the hotel-keeper, hostel

keeper".

Soction 8 of the principal Act shaH be amended as follows

(a) for subsecti on (I) thereof there shall be substit uted the

following

"(I ) No company shall operate a hotel, hostel or

catering establ ishment unless such hotel. hostel or catering

establishment is managed by a hotel-keeper, hostel keeper

or catering establishment keeper. as the case may be.";

rb) in subsection (2) thereof for the words "Where a hOle]"

and the words "of such hotel" there shall be substituted respectively

"Where a hOlel , a hoslel" and " of such hOlel, hostel"; and

(c) in subsection (3) thereof for the words "to act w; a hotel·

keeper or catering establishment keeper, as the case may be. of

Ihe hotel or caleri ng establishment" there shall be substituted the

words " to act as a

hotel-keeper , a hostel keeper or a

catering

establishment keeper, as the case may be, of the hOlel, hostel or

catering establishment",

Section 9 of the principal Act shall be amended as follows

(a) in subsection (l) thereof for the words "hotels and

catering establishments" and "a hotel or catering establishments"

Ihert: shall be substituted respectively the words "hotels, hostels and

catering establishments" and "a hotel. hostel or catering establish-

ment";

(b) in Sub6ectiOl1 (2) thereof for the words "an hotel or a

catering establishment" there shaH be substituted the words "a

hotel, a hostel Or a catering establiShment"; and

(c) in subsection (3) thereof for the words "Any person, who

in writing, adve!1ises or otherwise represents a hotel or catering

establishment as belonging to a higher category" there Shall be

substituted the words "Any person. who in writing. advertises or

otherwise rep resents an establishment as a hotel, hostel or catering

establishment wheu such establishment is not licensed by the Board

or if Iicf:nsed, so adve!1ises or represents an establiShment as

belonging to a higher category".

In section 9A of the principal Act for the words "When a

hotel" and the words "to the hotel or" there shall be substitu ted res-

pectively the ,,"'Ords "When a hotel Or a hostel" and "to the ho tel or

hostel. or".

16, Section 10 of the principal Act shall be amended as follows

(a) for subsection (I) thereof there ,\hall be substituted the

following

"(I) Where it appears to the Board, after such inquiry

as it may deem fit, that a hotel. a hostel or a catering

establishment is not being kept or managed in a manner

conformable 10 the standard of a hotel. a hostel or a catering

establishment of the category in which such hotel. hostel or

catering establishment is classified, in aOCord3oce with the

provisions of any regulations made under this Act. the Board

may, upOll giving notice thereof to Ihe hotel-keeper, hostel

keeper or catering establishnxnt keeper, all the case may be,

remo~ the name of such hotel. hostel or catering establish,

ment from such category and place it in a lower category,";

(b) in subsection (2) thereof for the words "a hotel or

catering establ ishment" and "the hotel-keeper or catering establish-

ment keeper" there shall be substituted respectively the words "a

hotel. hostel or catering establishment" and "the hotel-keeper,

hostel keepeT or catering establishment keeper".

Section 11 of the principal Act shall be amended as follows: Amendm.", of

(a) for the words "a hotel or catering establishment" in the priocipat

subsection (2) thereof there shall be substituted the words "a hotel. A<t.

hostel or catering establishment"; and

(h) for the words "hotel-teeper" in subsection (3) thereof

there shall be substituted the words " hotel-keeper, hostel keeper".

In Section 12 of the principal Act for tbe words "a botel or

catering establishment" in paragraph (h) of sub5ectiotl (1) thereof and

for the words "the botel·kccpcr Of' catering establishment keeper" in

sub$ection (4) thereof there shall be substituted respectively the words

"a hotel, hostel or catering establishment" and "\he hotel-keeper. hostel

keeper or catering establishment keeper".

In section 13 of the principal Act for the words "hotel- ...... _101

keeper" wherever they oc<:ur there shall be substituted \be words "hotel oerton II of

keqlCr or hostel keeper".

In subsection (I) of Se<:tion 14 of the principal Act for the section t. of

words "hotel or catering establishment" wherever they occur there shall th. principat

be substituted in each case the words "hotel. hostel or catering estab-

lishmeJu".

In se<:tion 15 of the principal Act for the words "hotels and .......Ddmeotol

e&tering establishment" wherever they occur and for the words "a oeetion

hotel-keeper or catering establishment keeper" tlJere shall be substituted

respectively the words Hhotels. hostels and catering establishments"

and "3 hotel-keeper. hostel keeper Of' catering cs.tablishment keeper" .

For section 16 of the principal Aet there shall be substituted SubtlitulioD of

the following

,~

"16. A hotel-keeper and a hostel keeper shall have the

right to retain any goods which a guest brings into the hotel

or hostel and which are in the possession of the hotel-keeper

or the hostel keeper oMil such guest has paid any mtes

lawfully charged by the hotel-keeper or hostel keeper as the

case may be.".

In subsection (2) of section 18 of the principal Act for tlJe Ameodme.t of

words "that a hotel or a catering establishment", "that such hotel or ..roan

catering establishment", "to such hotel or catering establishment", "the

hotel to which" and " of the hotel or of the catering establishment"

there shall be substituted respectively the words "that a hotel, a hostel

or a catering establishment". "that such hotel, hostel or catering estab-

lishment". Mto such hotel_ hostel or cateri ng establishment", the hotel

or hO!itel to which" and "of the hote\. of the hOi!ltel or of the catering

establishment".

Part rv of the principal Act is hereby repealed.

Immediately after section 19 at the principal Act there shall

be added the following new section

19. The provisions of the Probation of Offenders Act,

1957 shall not apply in relation to the offences under sections

4, 8, 9, 11, 13 and 14 of this Act and in relation to any breach

of any regulation made under section 15 of this Act.”.
