BE IT ENACfED by the President, by and with the advice and

consent of the HOLl5e of R eprcsc:n tBtives. in this prcscllt Parliament

assembled. and by the authority of the sa me, as follows:_

This Act may be dIed as the Medical and Kind red ProfCSJions

(Amendment) Act, 1985. and shan be read and construed U onc with

the Med ica l and Kindred Professions Ordinance. hereinafter referred 10

all "the principal law".

Seetion 4 of the principal law shall be amended as follows.

1. (a) in subsection (3) !Mreof after the words "i n . Govern-

meOI hospital or clinic" there shall be inserted the words "or in

any other brancb of the health $erYioe provided by Governrtlelll,";

(b) at the coo of subsection (3 ) there shall be added the

following proviso

"Provided that no person may pmctisc the medical profCSJiOD

in accordance with th is subsection in a branch of the heahh service

provided by GOIIernment other than a Government hospital or clinic,

unless such penon shall ha ve a l~ady served as a house physicia n!

surgeon in a Government hospital for a period of a year, wh iCh

period shall incl ude service both in the speciality of medicine and

that of 5Ilrgcry."; and

(c) in subsection (4) thereof aftec Ibe wordJ "house

pilysician/surgeon" there shan be inserted the words " in I Govt:m-

(a) in paragraph (h) of SlIbseclion (1) thereof after the words

and (2) of scctioo 4 of this Ordinance. a person required \()

by Govemmen l. in accordance wilh the provisiOllll of !he pr0-

viso to subsection (1) of this section. may ptaetise the medical

profession as a h(lUlle physician/surgeon in sucb hospital. clink

or branch of\he health service and in the perfOl'IllDnce of hill

duties assigned to him in that capacily such person shall fOf

all pu rposes of law be treBled as if he \\IeW licensed 10 pnlctise

the medical profession a nd the povt-ers of the Med ical Council

as provided in 5u~liao (4) of section 4 of this Ordinance

shall apply also in regard 10 such person

Provided Ibat no person may practise the med ical pr0-

fession in accordance with Ibis 1ubsoclion in a branch of the

heal!h servioe provided by Governmcnt olher Ih an a Govern-

ment hospital or clinic. unless such pcnon shall have alJe3dy

M'n 'ed as a hOllM' physician/surgeon in a Government hospital

for a period of a year. which period shall incl ude SCf'o'ice bolh

in Ihe spe<:iality of med icine and thal of surgery. ".

Immedialely afler subt\eclion (2) of section 17 of the prillCipal

la w there shall be ill!lc:rted Ihe following new subsection

"(3) Notwithstanding the pro-.·isions of paragraph (d) of sub-

section (I). and of SubseetiOll (2) of Ibis section. a person who

holds the qu alifICations mentioned in paragraphs (a), (h) and (c)

of subsectiOll (]) and who ~ses the necessary Ic:<:hnical qualifi_

cations obta ined from a fOR:ign cou.nlry, shaU qualify for the licence

referred 10 in subsection (I) of Ihis section if he produces a certifi·

cate from the Pha rmacy Board showing that the Board is s.atisfi cd

that he holds those qualifica tions and that the conditions (Of" the

granting of such qualiflClltions in the country c<:>noemed a ~ equiva·

For subsection ((\) of section 19 of the principal law there

stretch and no absences shall in the aggregate exceed ninety

ing any such drug or chemical product and the dispens·

ing of any ~uch prescription

(h) requiring persons engaged in the manufact ure,

ex porlation. im portation. sa le or distribution of any such

drug or chemica l product to keep and prodoce for

inspection such books and to furnish suc h in form ation

as may be prescribed;

(c) requi ring and regula ling the labelling and

marking of any such psychotropic drug and regula ting

any advertisement thercaf.

For the purpose of this section. the term

means any drug or chemica l listed in

the Third Schedule to this Ord inance.

(3) The Mini~ter of Health may. after consulting

the Council of Health. by regulat ion amend. add 10. revoke

this section shall be tried in the Crimi nal Court or before the

Court of Magistrates of Judicial Police as the Attorney

(3) No person shall. on conviction for any offence

of contravening or failing to comply with any regulation

sentenced to imprisonment without the option of a fiue or

(4) If any person attemptS to commit an offence

against Ibis section. or solicits or incites another person to

commit Jl,lCh an offence, he shall. without pR:judioce to any

other liability. be liable on conviction to Ille same punish-

ment aod forfeiture as if lie had comminoo an otfCIlCC under

Ibis section.

(s) Where the offence in respect of which D person

fession, or a calling or a trade, or the offence is oommitltd

afor=lid, the Court shall at the request of the prosecution

a nd in addi tioo to any other punishmcnl. order the revoca-

tion of such licence or wammt and upon sucb order being

made any such licence or warrant shall Cea!;e to bave effect

for all purposes of law and in particular for the purposes of

this OrdillllJlce aoo of. the Ordinance aforesaid.

(6) Where it ~ts to the Court that the offender

not being 11. PCI"$Oll who imports, manufactures, sells or other-

wise deals in any psychotropic drug, is in need of medical

care and ass.islaooe for his rehabilitation, the Court may.

instead of applyIng any of the punisblll("nll provided tor in

the foregoing 5Ub5ections order that the offender be remilltd

to an institution approved for the purpose by the Minister

rc$ponsible for health in order that he may be give n the

necessary matment.

The Coun shall cause such order to be forthwith

eonw:yed to tbe Minister ft'SPOOSiblc for health who will give

sucb directil'e$ as be may deem fi t for the eare and treatment

of any such person.~.

The Drugs (Control) Regulations.
