AN ACT IQ reperu the Milk Marketing Undertaking (Appropriation)

Ordinance. Cap, 177.

BE IT ENACTED by Ihe President, by and with the advice and

consenl of the House of RepresentatiVes, in this present Parliament

assembled, and by the authority of the same, as fo!1ows:_

This Act may be ci ted as the Milk Marketing Undertaking a lation and

(Appropri ation) (Repeal) Act, 1985, and shall come into force on !he Oommcnc...-t.

The Milk Marketing Undertaking (A ppropriation) Ordinance, Repeal ot !be

Chapter 171, hereinafter in Ihis Act referred to as "the Ordinance" is Mil.

hereby repealed,

J. (]) Notwithstanding the repeal of the Ordinance all moneys Tl1JISi.'ory

due to or by the Milk Marketing Undertaking up to the 31st day of pt""isi"",.

December, 1985. shall continue to be governed by sections 2 and 3 of

the Ordi nance. and shall after that date be due to. or payable by. the

Director of Agriculture and Fisheries and shall be credited to or paid out

of the Acrouol referred 10 in section 2 of the Ordinance, hereinafter in

this Act reterred to as "the Account" , and the provisions of section 4 of

th e Ordinance shall not apply to any balance standing to the credit of the

Account at the end of the financial year ending on 31st Deeemher. 1985.

(2) The Director of Agriculture and Fisheries shall as soon as

may be after the 3 1st December. 1985, coHcet all moneys and pay all

moneys, due to or payable ont of the Account and shall, not later than

the 30th April. 1986, wind up the Account ma king a statement of such

winding up 10 the Acwuntant General. All moneys standing to Ihe credit

of the Account after the Account shall have been wound lip shall be

appropriated to the Consolidated Fund.

(3) Notwithstanding the provisions of any other law the

Accountant General shall forward to the Director of Audit the statement

showing the revenue and expenditure aocounts and a statement contain-

ing a proper balance sheet of the M ilk Marketing Undertaking for the

financial year 1985 together with the statement of the winding up of the

Account not later than two months after the said Account shall have been

wound up. and subsection (2) of sectIon 62 of tbe Financial AdmInIstra-

tion and Audit Act, 1962, shall apply to such statements.

(4)

Any monc)'s outstanding after the winding up of the

Account shall -

(a) on receipt by the Di rector of Agriculture and Fisheries be

appropriated to the Consolidated F und; and

(b) on payment by him be met out of an appropriate expendi-

ture vote.
