AN ACT fur/her to amend rhe Enemalra Ac/, 1977.

BE IT ENAcrED by the Presiden!. by and with the advi<.:e and

consen! of the House of Representatives, in thi.! present Parliament

assembled. and by the authority of the same. as follows:_

I . This Act may be cited as the En~malta (Amendment) Act, s.r. ... ,

1983 and shall be r~ad and construed a~ one with the Enemal!a ACI.

1977, hereinafter referred to as "Ihe principal Act".

Section 21 of the principal Act shall be amended IU foHows: A~' "I

(a) in subsection (1) thereof for th~ words "afler the end of _'iOll

each such year" there shall be substituted the words "before the

end of each such year"; anc!

(b) for subsection (4) thereof there shall be substituted the

following

"(4) The Minister shall. at the earliest opportuniry and

not later than the flfllt silting of the House after four weeks

from the rereipt of the copy of the estimates of Enemalta ro-

ferred 10 in subseclion (3) or this seclion. cause such estima tes

to be laid before tile House of Representatives together with

a motion that the Home Bpnrnvc the said estimates. Not more

than {WO siltings shall be allotted for the debate in the House

on such a motion; and both the motion and the approval of

the estimates by the House may be with or witboul amend·

menu 10 the estimates.".

J. For section 22 of the principal Ac! there shall be lubstituted

the following

(2) The accounts of E nemalt.l shall be audited by

an auditor or a uditors to be appointed by it a nd approved

by Ihe M inister

Provided that the Minister may require the boots

and atOO\lnis of the Corporation to be aud ited or eumined

by the Di r~IOT or Audit who sball for this purpose have

power to carry OIIt such physical ch~k ing and other verifica ·

tiollS U he may deem neceliSary,

(3) The interim statement of alXOUnt in respect of

the first period of six months of each financial year, duly

a ud ited, shall be adopted by the Board not later than six

weeks after the end of $uch period and shall be transmitted

forthwith to the Minister together with a copy of any report

made by the auditor or a uditors on that statement or On ilie

_«wnts of the Corporatioo.

(4) The statentent of account in respect of the

500000 period of six months of each financial ~ar. together

with tbe statement of acrount in respect o f the whole finan·

cial year, both duly a udited. shall be adopted by the Board

not later than ten Wttks after tlte end of the financia l year.

and shall be tranlmined forthwith to tbe M inister together

with a copy of any report made by tbe auditor or a uditors

on those statements or on the acoouDts of the Corporation.
