BE IT ENACTED by the President. by and with the advice and

coniiICnt of the Horu;c of RepresenUti,""s, in this present Parliament

assembled. and hy the authority 01 the same. as follows:-

I. Th is Act may be cited as the Medical and Kindred Prolessions

(Ameodmenll Act. 1983. and shall be read and construed as one with

the Medical and Kindred Professions Ordinance. hereinafter referred

10 as "the principal law~.

(]) In the principal law. for the words "as'listant apOthe. Cba ... iD

C'dry". "assistant apOthecaries" and "Assistant ApOthecaries' Register" d..;p.tioo

wherever they occur there shall be suhstituted respectively the words 01

"pbanoacy tochnician". "pharmacy technicians" and "Pharmacy Toch·

nicians' Register".

(2) [0 the principal law, for the words "Advisory and E~eaI' Ikw<d lor tbo

live Board" wherever they occur except in section 75 thereof. there shall ~~

be substituted the words "Board for the PrdeS'lions Supplementary to ••

Medicine".

Section 2 of the principal law shall he amended as follows

(a) io subsection (I) thereof. for the words "medical aUJlilia·

Tie3 . midwives. registered nurses and enrolled nurses~ tbere shall

be substituted the words "'midwive3. registered nurses . enrolled

nUl~es and persons referred to

in !lection 73 D of this Ordinance,";

(h) in paragraph (c) of subsection (2) thereof. for the words

"Medical D.UJIiliaries" there shall be substituted the words "tbe per·

sons referred 10 in section 73D of this Ordinance".

Immediately at the end of SC\:Iion 4 of the principal law there

shall be added the following new subsection

"(6) The Minister of Health may by regulations prescribe the

qualifications which a foreign physician or snrgeon must have be-

fore a licence under subsection (5) of this section may be granled.".

5, In the Maltese texl of subsection (3) of section 5 of the princi·

pal law for the words "kontra isimha" there shall be substiluled Ihe

(2) Immedialely aller sUbse<:tion (1) of seclion 6 of Ihe prin-

ci pa l law, as re-numbered, there shalt be added tbe following new su],.

"(2) Jt shalt be Ihe duty of every medical pmclitioner examin-

ing or treating a patienl suffering from any disease or injury as is

mentioned in the Sevenlh Schedule to Ihe National Insurance Act.

1956, which disease or injury was, in Ihe opinion of the said medica l

practitioner, taused by or connected wilh Ihe relative occuration

mentioned in the said Schedule, to give immediate notice in writing

to the SUpt:'rintendent of Public Health in the form set out in Part 2

of the First Schedule to thi$ Ordinance,",

Immediately at the end of subsection (2) of section 17 of the

principal law there shan be added the following proviso

"Provided that a candidate who has given notification as pro-

vided under paragraph (d) of subsection (I) of th is sectioo prior

to the first day of January 1974. shall not, after the thirtieth day

of June, 1984 be entitled to si t for the examinations referred to

in this subsection on the strength of such notification.",

For section 18 of the principal law there shall be substituted SubstilUlioao of

the following

" '8. m Tt shall not be lawful for any person 10 open or

keep a dispensary unleSil there is in respect of ruch premises a

li<:ence issued by the Superintendent of Public Health.

(2) The Ii<:ense.. of a dispensary shan not close such

dispensary unless he has given at least 24 hours previowJ notice to

the Superintendent of Puhlic Health.

(3) The said Superintendent may, on the re<.:eipt of a

notice as is referred to in subsection (2) of this section, or where

it has oome to his knowledge Ihal a dispensary has been closed,

seal all Ihe medical substances, wherever kept by the licensee in

accordance with the provisions of this Ordinan<:e, and take charge

of any register required to be kept by such licensee under any

law.",

For section 58 of the principal law ther"<' shan be substituted

58. (]) No person may practise as a dental surgeon

(2) Without prejud ice to the provisions of subsec-

tions (3) and (4) of Ihis section no person shall qualify to

obtain a licence to practise as a dental surgeon or dentist un-

less _

(a) he is a citi~en of Malta;

Cb) he is of good character. and

(c) his name is entered in the Register of Den tal

Surgeons.

(3) The Presiden t of the Repuhlk. on the advice

of the Medical Coundl. may grant a temporary licence to any

pt:'rson who holds the quailfications referred to in paragraphs

(a) and (bl of subsection (2) of this section and has qualified

for the degree or diploma in Dental Surgery of the University

of Malta,

(4) The President of the Republic may grant a

temporary licence of a perind nO! exceedi ng two years to any

foreign dental surgeon and may subject such licence to any

condition as he may deem appropriate: and the Medical

Council shall enter the name of any such foreign dental sur-

geon in a special part of the Register of Dental Surgeons, to.

gether with lhe lim itations and conditions 10 which the lice nce

is .ubject.

(5) The ]l,liuister of Health may by regulations

prescribe the qualifications which a foreign dental surgeon

must have before a licence under subsection (4) of this section

may be granted."'.

For section 59 of the principal law t!lere shall be substituted

the follow ing

59. (!) The Medical Cou nci l shaH keep a register, in

thi s Ordinance referred to as the Register of Denial Surgeons

in which s!lall be entered -

(a) the name of every person who holds a degree

or diploma in Dental Surgery of the Un iversity of Malta;

(b) the name of e~ery person whose name is en·

tered in such list or register kept in a country other than

Malta. as are required to be recoSOised by Malla under

and for the purposes of arrangement~ whereby full re-

ciprocity exists regarding the recognition of qualifica·

tions in dental surgery between Malta and the country

in which ~uch qu alifica tions are obtained; and

(e) the name of every citilen of Malta who holds

a suitable qualification in dental surgery granted by a

dental school recognised by the Medica l Council and

who passes a practical and oral t~st in Dental Surgery

Provided that no person shall have his name entered

in the Register of ~ntal Surgeons under paragraph (b) or (cl

of this subsection. unless either su ch person has served as a

house dental surgeon in a Government hospital Or clinic for a

period of two years. or such lesser period as the Minister res·

ponsible for public health may. after consultation with the

Medica l Council determine. Or the ""id Minister has b)' notice

to the Medical Council d""lared that such service is nQl re·

quired

I'rovided further that notwithstanding any provision

of th is Ordinance a person serving as a house dental surgeon

in a Governme nt hospilal or clinic for the purposes of this

subsection. and in the performance of the duties assigned to

him in that capacity shall for 311 purposes of law, be treated

as if he were licensed to practise lhe profession of den1al

surgeOfl .

(2) In reg~rd to any pe rson exerc;" ing the profes·

sion of dental surgeon as provided in the proviso to subso:c-

tion iI) of this section. the powers of the Medica l Coun=il

under section 87A of th ;" Ordinance shall include the power

to order that such person shall nOI practise the professiOll of

dental .mgeon even as a house denta l surgeon and that his

name shall not be ente red in Ihe Register of Dental Surgeons

and where any such order has been made. it sha ll . for the

p~rposes of Ihi s Ordinance. ha,·c effect as if the name of such

~rson hu ~en erased from the .a id Regjjter.

13) In regard 10 any person as referred to in suI>-

section (2) of this se<.:tion. the Medical Council may give a ny

order und inflict a ny pen alty as provided in se<.:tion 81A of

this Ord inunce as if sueh persons were registered a5 dental

surgeons.

medical laboratory technicians. occupational therapists. radio-

graphers. speech therapists, heal th inspectors and of other persons

who are qualified in any other recognised profession supplem entary

10 medicine as the Minister of Health may by notice in the Gazetle

declare, shall be ke pt by the Board for the Professions Supplemen-

tary to M edicine.".

For sections 73F and 73G of the principal law the re sha!! be

substituted tbe following new sections

"73F. Any peJ"S()n whose name is entered in any of the

registers referred to in section 73D shall be granted a certificate

signed by the Chairman of the Board for the Professions Supple-

mentary to Medicine. stating Ihat such peJ"S()n is entitled to take a nd

use the description of the profession supplementary to medicine ;n

respect o f which he is registered.

73G. It shall not be lawful for any person to -

(a) exercise any profession to which sui>se<:tion (I ) of

section 73D refers. unlcss his name is registered under Ihis

Part in respect to the profession he intends to exercise;

(h) ta ke Or use the name or title of any profession eitber

alone or in combination with other words or letters, other than

the onc in respect of which he is registered under this Part;

(e) take or use any name. title. addition. description.

uniform or badge implying that he is registered under th is Or·

dinance in respect of a profession other than the profession

in respect of wh ich he is registered under this Part;

(d ) make use in the exercise of any of the professions

referred to in subsection (1) of section 73 D of any certificate of

registration issued to any other person.".

In paragraph (3) of section 7S of the principal law . for the

words "Advisory and Executive Board" there shall be substituted the

W<)rds "Council of Health".
