BE IT ENACTED by tbe President, by and with the advice and

cons,ent of the Howe of Repre5eOlalives. in tllis present Parliament

~mbled. and by the aUlhoriry of the same, as 10110\11'5: -

I. Thi, Act may be cited as the Transfer of Immovables (Regula·

Act, 1982.

In this Act _

Mappoinled day~ means the 22nd day of lXC<'mher, 1982

"Commissioner" mcum the Commissioner of Land

"emphyteutical pnC means the grant in empbytcusis Or SII~

empbyteusis of any land. building or Oilier construction and

includes any contract whc:~by any groundll:ol is imposed or

iD~sed in respecl of any property as aforesa id

"grant" means an emphyteutical grant;

"prdiminary agrttJl'lcot" means an agnemenl whereby 0111

pari)' promises 10 (ransl..,. and anolher party promises 10 acquire

immovable property.

"transfer" includes sale and any other transfer of immovables

by onerous title and includes emphyteutical InlDIs.

rn issioner for the execution of the deed of transfer given in accordance

with section 4 of this Act, or otherwise than in strict oompliaoce with I

(]) The Commissioner shall not give his perm ission for tlx

(a) a preliminary agreement in writing incorporating all the

terms and eooditions of !he transfer has been duly enleTCd into;

expiration of the period of validity of lhe preliminary agreement;

(e) the Commissioner is ~Ii$rted that the tCTTIII and condi-

tions of the propostd lransfer are n01 more onerous than those 0b-

taining on the open markel OD the 16th day of No~mber. 1982.

(2) Where the CommiS5ioner is not satisfied as provided in

paragraph (e) of Ihe immediately precc.eding substttion. he may notify

10 tl>c applicant for pormission tile terms and conditions under which

the transfer may be effocted. being lenM and conditions ""hieh satisfy tile

provisions of the paragraph as aforesaid. and in any such case such

notice shall have the same effect as a pcnn ission pnled by him for

Provided that. if at any lime while this Act is in force a Reso-

lution is passed by the House of RepresentativC5 that this Act shaH w n·

wise e~pire. this Act shall continue in force for such further period..
