S.I. No. 210/2025 - European Communities (Intra-Community Transfers of Defence Related Products) (Amendment) Regulations 2025

1. These Regulations may be cited as the European Communities (Intra-Community Transfers of Defence Related Products) (Amendment) Regulations 2025.

2. Regulation 2 of the European Communities (Intra-Community Transfers of Defence Related Products) Regulations 2011 (

S.I. No. 346 of 2011

) is amended, in paragraph (1), by the substitution of the following definition of ‘Directive’

‘Directive’ means Directive 2009/43/EC of the European Parliament and of the Council of 6 May 2009

simplifying the terms and conditions of transfers of defence-related products within the Community as amended by –

(a) Commission Directive 2010/80/EU of 22 November 2010

3. European Communities (Intra-Community Transfers of Defence Related Products) (Amendment) Regulations 2024 (

) are revoked.

EXPLANATORY NOTE

The purpose of the Intra Communities Transfer Directive (Directive 2009/43/EEC of the European Parliament and of the Council of 6 May 2009) is to simplify the rules and procedures applicable to the intra-Community transfer of defence related products.

The list of products covered by Directive 2009/43/EEC is the “EU Common Military List”. As the common military list is updated regularly, the Directive is also updated with an amended list. These Regulations implement and give effect to Commission Delegated Directive (EU) 2025/290 of 4 October 2024 to reflect the amendments made in the EU Common Military List.
