S.I. No. 153/2020 - Health Act 1947 (Section 31A

1. These Regulations may be cited as the Health Act 1947 (Section 31A – Temporary Restrictions) (Covid-19) (Amendment) (No. 2) Regulations 2020.

2. Paragraph (b) of Regulation 3 shall come into operation on the 5

th

day of May 2020.

3. The Health Act 1947 (Section 31A – Temporary Restrictions) (Covid-19) Regulations 2020 (

S.I. No. 121 of 2020

) (amended by the Health Act 1947 (Section 31A – Temporary Restrictions) (Covid-19) (Amendment) Regulations 2020 (

S.I. No. 128 of 2020

)) are amended -

(

a

) in Regulation 2, by the substitution of “the 18

th

day of May 2020” for “the 5

th

day of May 2020”, and

(

b

) in Regulation 4(2)(i), by the substitution of “within a 5 kilometre radius of that residence” for “within a 2 kilometre radius of that residence”.

These Regulations amend Regulation 2 the Health Act 1947 (Section 31A-Temporary Restrictions) (Covid-19) Regulations 2020 (

S.I. No. 121 of 2020

) to provide that the Regulations shall remain in operation until 18 May 2020. The Regulations also amend Regulation 4(2)(i) to extend the radius referred to there from 2 kilometres to 5 kilometres. The amendment to Regulation 4 will come into effect on 5 May 2020.

The Minister for Health, in exercise of the powers conferred on him by sections 5 and 31A (inserted by

section 10

of the

Health (Preservation and Protection and other Emergency Measures in the Public Interest) Act 2020

(No. 1 of 2020)) of the

Health Act 1947

(No. 28 of 1947) and -

(

a

) having regard to the immediate, exceptional and manifest risk posed to human life and public health by the spread of Covid-19 and to the matters specified in subsection (2) of section 31A, and

(

b

) having consulted with the Minister for Finance, the Minister for Public Expenditure and Reform and the Minister for Justice and Equality,

hereby makes the following regulations
