1. These Regulations may be cited as the European Union (Cereal Seed) (Amendment) Regulations 2018.

2. The European Union (Cereal Seed) Regulations 2013 (

S.I. No. 217 of 2013

) are amended in Regulation 2(1) by substituting for the definition of “Directive” (as amended by the European Union (Cereal Seed) (Amendment) Regulations 2017 (

)) the following

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation)

These Regulations give effect to the provisions of Commission Implementing Directive (EU) 2018/1027/ which amends Council Directive 66/402 as regards the isolation distances for sorghum spp.

Council Directive 66/402 sets down the principles by which cereal seed is marketed within the Community. The Directive requires each Member States implements controls to ensure cereal seed may not be placed on the market unless it has been officially certified as “basic seed”, “certified seed”, “certified seed, first generation” or “certified seed, second generation” and unless it satisfies the conditions set down in the accompanying Annexes.
